THE COUNCIL OF THE CITY OF NEW YORK

RESOLUTION NO. 817

 

Resolution approving the decision of the City Planning Commission on ULURP No. C 010284 MMX, an amendment to the City Map (L.U. No. 400).

 

By Council Members Katz and Garodnick

 

                           WHEREAS, the City Planning Commission filed with the Council on March 5, 2007 its decision dated February 28, 2007 (the "Decision"), on the application submitted by Horace Mann School, pursuant to Sections 197-c and 199 of the New York City Charter and Section 5-430 et seq. of the New York City Administrative Code, for an amendment to the City Map involving:

 

                     the elimination, discontinuance and closing of West 250th Street between Tibbett Avenue and The Post Road;

 

                     the adjustment of grades necessitated thereby; and

 

                     any acquisition or disposition of real property related thereto,

 

in accordance with Map No. 13097, dated September 3, 2002 and signed by the Borough President (ULURP No. C 010284 MMX), Community District 8, Borough of the Bronx (the "Application");

 

                     WHEREAS, the Application is related to ULURP Application No. C 010283 MMX (L.U. No. 399), an amendment to the City Map involving the elimination, discontinuance and closing of The Post Road north of West 246th Street;

 

                           WHEREAS, the Decision is subject to review and action by the Council pursuant to Section 197-d(b)(3) of the City Charter;

 

                           WHEREAS, upon due notice, the Council held a public hearing on the Decision and Application on April 11, 2007;

 

                           WHEREAS, the Council has considered the land use implications and other policy issues relating to the Decision and Application; and

 

 

 

 

WHEREAS, the Council has considered the relevant environmental issues and the Negative Declaration, issued on March 12, 2001 (CEQR No. 01DCP036X);

 

RESOLVED:

 

                           The Council finds the action described herein will have no significant effect on the environment.

 

                           Pursuant to Sections 197-d and 199 of the New York City Charter, the Council approves the Decision.
