THE COUNCIL OF THE CITY OF NEW YORK

RESOLUTION NO. 791

 

Resolution approving the decision of the City Planning Commission on ULURP No. C 050414 ZMM, a Zoning Map change (L.U. No. 383).

WHEREAS, the City Planning Commission filed with the Council on February 14, 2007 its decision dated February 7, 2007 (the "Decision"), on the application submitted by A & C Development Partners, pursuant to Sections 197-c and 201 of the New York City Charter, for an amendment to the Zoning Map (ULURP No. C 050414 ZMM) (the "Application");

 

WHEREAS, the Decision is subject to review and action by the Council pursuant to Section 197-d(b)(1) of the City Charter;

 

WHEREAS, upon due notice, the Council held a public hearing on the Decision and Application on March 20, 2007;

 

WHEREAS, the Council has considered the land use implications and other policy issues relating to the Decision and Application; and

 

                      WHEREAS, the Council has considered the relevant environmental issues and the Conditional Negative Declaration, issued on September 25, 2006 (CEQR No. 05DCP070M) which states:

 

The applicant signed the Conditional Negative Declaration on September 20, 2006, and it was issued on January 8, 2007. The Conditional Negative Declaration was published in the City Record and in the New York State Environmental Notice Bulletin on September 27, 2006.  Pursuant to the SEQRA regulations set forth in Volume 6 of the New York State Code of Rules and Regulations, Section 617.00 et seq., a comment period followed. No comments were received.

 

RESOLVED:

 

The Council finds that the action described herein will have no significant effect on the environment once the conditions stated in CPC Report (C 050414 ZMM) are implemented;

 

Pursuant to Sections 197-d and 200 of the City Charter and on the basis of the Decision and Application, the Council approves the Decision.

 

The Zoning Resolution of the City of New York, effective as of December 15, 1961, and as subsequently amended, is further amended by changing the Zoning Map, Section No. 6a:

 

1.                      eliminating from within an existing R7-2 District, a C1-4 District bounded by West 145th Street, a line 100 feet easterly of Adam Clayton Powell Jr. Boulevard, West 144th Street, and Adam Clayton Powell Jr. Boulevard;

 

2.                      changing from an R7-2 District to a C4-4D District property bounded by West 145th Street, a line 100 feet easterly of Adam Clayton Powell Jr. Boulevard, West 144th Street, and Adam Clayton Powell Jr. Boulevard; and

 

3.                      changing from a C8-3 District to a C4-4D District property bounded by West 145th Street, a line 160 feet easterly of Adam Clayton Powell Jr. Boulevard, a line midway between West 144th Street and West 145th Street, and a line 100 feet easterly of Adam Clayton Powell Jr. Boulevard;

 

as shown on a diagram (for illustrative purposes only) dated September 25, 2006 and which includes the Environmental Designation E-173,  Community District 10, Borough of Manhattan.
