RESOLUTION NO. 446

 

Resolution affirming the designation by the Landmarks Preservation Commission of the Stewart & Company Building located at 402-404 Fifth Avenue, aka 2 West 37th Street (Block 838, Lot 48), Manhattan, Designation List No. 372, LP-2185 (L.U. No. 182; 20065498 HKM; N 060454 HKM).

WHEREAS, the Landmarks Preservation Commission filed with the Council on May 1, 2006 a copy of its designation dated April 18, 2006 (the "Designation"), of the Stewart & Company Building located at 402-404 Fifth Avenue (aka 2 West 37th Street), Community District 5, Borough of Manhattan, as an historic landmark and Block 838, Lot 48, as its landmark site pursuant to Section 3020 of the New York City Charter;

 

WHEREAS, the Designation is subject to review by the Council pursuant to Section 3020 of the City Charter;

 

WHEREAS, the City Planning Commission submitted to the Council on June 9, 2006 its report on the Designation dated June 7, 2006 (the "Report");

 

WHEREAS, upon due notice, the Council held a public hearing on the Designation on July 17, 2006; and

 

WHEREAS, the Council has considered the land use implications and other policy issues relating to the Designation;

 

RESOLVED:

 

Pursuant to Section 3020 of the City Charter, and on the basis of the information and materials contained in the Designation and the Report, the Council affirms the Designation.
