THE COUNCIL OF THE CITY OF NEW YORK

RESOLUTION NO. 421

 

Resolution approving the lease agreement of real property generally located at the South Brooklyn Marine Terminal (Block 662, portions of Lots 1 and 155), Brooklyn (20065414  PNK; L.U. No. 180).

 

By Council Members Katz and Lappin

 

                           WHEREAS, the Department of Small Business Services filed with the Council on June 1, 2006, pursuant to Sections 1301(2)(f) and (g) of the New York City Charter, a lease agreement between the City of New York Department of Small Business Services and the Axis Group, Inc. of property generally located at South Brooklyn Marine Terminal consisting of 74 acres of real property including a public berth area at the 39th Street Pier (Block 662, portions of Lots 1 and 155) (a diagram of which is attached hereto as Exhibit A-1 of the lease), upon terms and conditions set forth in the Lease Agreement, a copy of which is attached hereto (the "Lease"), Community District 7, Borough of Brooklyn;

 

                           WHEREAS, the Lease Agreement is subject to review and action by the Council pursuant to Sections 1301(2)(f) and (g) of the New York City Charter;

 

                           WHEREAS, upon due notice, the Council held a public hearing on the Lease on June 20, 2006;

 

                     WHEREAS, the Council has considered the relevant environmental review (CEQR No. 06SBS005K) and the fact that a Negative Declaration was issued on April 5, 2006;

 

                           WHEREAS, the Council has considered the land use and financial implications and other policy issues relating to the Lease;

 

RESOLVED:

 

                     The Council finds that the action described herein shall have no significant effect on the environment.

 

                           Pursuant to Sections 1301(2)(f) and (g) of the New York City Charter, the Council approves the Lease and upon the terms and conditions set forth in the Lease Agreement by the Department of Small Business Services, a copy of which is attached hereto.
