Resolution finding that submission by the department of sanitation of a proposed final comprehensive solid waste management plan dated July 19, 2006 to the New York state department of environmental conservation conforms to the New York state environmental quality review act.

Whereas, The Department of Sanitation has prepared and presented to the Council, pursuant to article 27 of the New York State Environmental Conservation Law and section 360-15.11 of Title 6 of the Official Compilation of the Codes, Rules and Regulations of the State of New York, a Proposed Final Comprehensive Solid Waste Management Plan dated July 19, 2006 which is to be submitted to the New York State Department of Environmental Conservation; and
Whereas, The Department of Sanitation has also issued a Notice of Completion for a Final Environmental Impact Statement in conjunction with such Proposed Final Comprehensive Solid Waste Management Plan; and
Whereas, The Council has considered the relevant environmental issues and such Final Environmental Impact Statement; now, therefore, be it
Resolved, That the Council of the City of New York, having considered the Final Environmental Impact Statement, hereby finds that:
(1) the requirements of The State Environmental Quality Review Act and Part 617 of Title 6 of the Official Compilation of the Codes, Rules and Regulations of the State of New York have been met;
(2) consistent with social, economic and other essential considerations, from among the reasonable alternatives thereto, the proposed action is one which minimizes or avoids adverse environmental effects to the maximum extent possible, including the effects disclosed in the Final Environmental Impact Statement; and
(3) consistent with social, economic and other essential considerations, to the maximum extent practicable, any adverse environmental effects revealed in the environmental impact statement process will be minimized or avoided by incorporating as conditions in the Proposed Final Comprehensive Solid Waste Management Plan those mitigation measures which were identified as practicable; and
(4) the Proposed Final Comprehensive Solid Waste Management Plan and the Final Environmental Impact Statement constitute the written statement of facts and conclusions, and of social, economic and other facts and standards that form the basis of this determination.
