Resolution approving the site plan for a public intermediate/high school facility to be located on the west side of Essex Drive, south of Richmond Hill Road (Block 2450, Lots 80, 85, 320 and 600), Staten Island, (Non-ULURP No. 20055201 SCR; L.U. No. 482).

WHEREAS, the New York City School Construction Authority submitted to the Council on May 13, 2005, a site plan pursuant to Section 1732 of the New York State Public Authorities Law for a New 1,652-seat Intermediate/High School Facility known as I.S./H.S. 43, Staten Island to be located on the west side of Essex Drive, south of Richmond Hill Road (Block 2450, Lots 80, 85, 320 and 600), DOE Instructional Region No. 7, Community District 2, Borough of Staten Island (the "Site Plan");

WHEREAS, the Site Plan is subject to review and action by the Council pursuant to Section 1732 of the New York State Public Authorities Law;

WHEREAS, upon due notice, the Council held a public hearing on the Site Plan on May 17, 2005;

WHEREAS, the Council has considered the relevant environmental issues and the Final Environmental Impact Statement (“FEIS”) for which a Notice of Completion was issued on May 2, 2005 (SEQR Project Number 05-008); and

WHEREAS, the Council has considered the land use implications and other policy issues relating to the Site Plan;

RESOLVED:

Having considered the FEIS, with respect to the Application, the Council finds that:

(1) The FEIS meets the requirements of 6 N.Y.C.R.R. Part 617;

From among the reasonable alternatives thereto, the actions to be approved are ones which minimize or avoid adverse environmental impacts to the maximum extent practicable; and

The adverse environmental impacts revealed in the FEIS will be minimized or avoided to the maximum extent practicable by incorporating as conditions to the approval those mitigative measures that were identified as practicable;

The Decision and the FEIS constitute the written statement of facts, and of social, economic and other factors and standards that form the basis of the decision, pursuant to 6 N.Y.C.R.R. §617.11(d).

Pursuant to Section 1732 of the Public Authorities Law, the Council approves the Site Plan.
