RESOLUTION NO. 639
Resolution approving a motion to file pursuant to withdrawal of the petition for a revocable consent for an unenclosed small sidewalk café located at 224 West 49th Street, Manhattan (20045662 TCM; L.U. No. 270).

WHEREAS, the Department of Consumer Affairs filed with the Council on September 3, 2004 its approval of the petition of Inch Food and Beverage LLC., d/b/a Oceo, for a revocable consent to establish, maintain and operate an unenclosed small sidewalk café located at 224 West 49th Street, Community District 5, Borough of Manhattan (the "Petition"), pursuant to Section 20-226 of the New York City Administrative Code (the "Administrative Code");
WHEREAS, the Petition is subject to review by the Council pursuant to Section 20-226(g) of the Administrative Code;
WHEREAS, upon due notice, the Council held a public hearing on the Petition on October 5, 2004; and
WHEREAS, by letter dated October 5, 2004 the applicant withdrew the petition;
RESOLVED:
Pursuant to Rules 6.40a and 11.80 of the Rules of the Council, the Council approves the motion to file pursuant to withdrawal.
