Res. No. 1088 Title Resolution calling on the New York State Legislature to ban the building of private roads in New York City. Body By Council Members McMahon, Comrie and Lopez Whereas, Regulation of truck traffic in the streets of New York is necessary to ensure public health, safety and welfare; and Whereas, Section thirty-six of article three of the New York State General City Law prohibits the construction of private roads in municipalities with fewer than one million residents, but allows such construction in municipalities with more than one million residents; and Whereas, New York City is the only municipality in the State of New York with more than one million residents; and Whereas, Private streets are used by real estate developers as a means ensuring that any property is developed to the maximum density possible; and Whereas, Real estate developers often demolish one family homes on a lot, and build a private road into the center of that lot, allowing more than one home to be constructed on that lot; and Whereas, Residents of the homes facing the private roads pay the same property taxes as residents of homes facing public streets, but do not receive the same services from the city, such as the maintenance of private roads, including services such as pot hole repair, snow removal; and Whereas, Private roads are not located on City maps, and are difficult for emergency vehicles to locate; and Resolved, That the New York City Council calls on the New York State Legislature to amend the General City Law to ban the building of private roads in New York City.
