Res. No. 1083 Title Resolution amending Resolution No. 1004 (L.U. 226-A) adopted by the Council on August 19, 2003. Body By The Speaker (Council Member Miller) and Council Members Avella, Katz and Comrie Whereas, on August 19, 2003 the Council adopted a Resolution authorizing the Department of Transportation to grant nonexclusive franchises for the installation, operation and maintenance of coordinated franchise structures; and Whereas, said Resolution stated, inter alia, that such a franchise "may include additional public service structures ("PSSs") that shall ...be limited to trash receptacles, multi-rack news racks and information/computer kiosks.."; and Whereas, the council seeks to clarify its intent with regard to the inclusion of multi-rack news racks in such a franchise; now therefore, be it Resolved, that the Council hereby amends Resolution 1004 (L.U. 226-A) to read as follows: (Underlined matter is new). NINTH, that I the event that any of the franchise structures include newspaper or periodical dispensers, boxes or racks, such dispensers, boxes or racks shall be installed, maintained, and removed in accordance with all laws, rules, and regulations adopted by the City of New York. Nothing herein shall be construed to require any publication to utilize the dispensers, boxes or racks of a franchisee and nothing herein shall be construed to prevent any publication from having its own dispensers, boxes or racks consistent with applicable laws and regulations.
