Title: Resolution calling upon the New York State Legislature to revise the State Retirement and Social Security law to ensure that all State and City employees who are hired in the future who are later convicted of or plead guilty to serious criminal conduct in connection with their State or City employment will be prohibited from collecting the publicly funded portion of their pension, or, alternatively, to grant the City the authority to enact legislation prohibiting City employees who are hired in the future who are later convicted of or plead guilty to serious criminal conduct in connection with their City employment from collecting the publicly funded portion of their pension.

Res. No. 1001 Title Resolution calling upon the New York State Legislature to revise the State Retirement and Social Security law to ensure that all State and City employees who are hired in the future who are later convicted of or plead guilty to serious criminal conduct in connection with their State or City employment will be prohibited from collecting the publicly funded portion of their pension, or, alternatively, to grant the City the authority to enact legislation prohibiting City employees who are hired in the future who are later convicted of or plead guilty to serious criminal conduct in connection with their City employment from collecting the publicly funded portion of their pension. Body By Council Member Yassky, The Speaker (Council Member Miller) and Council Members Avella, Fidler, Liu, Quinn, Reed, Rivera, Stewart, Oddo, Comrie, Gerson, Katz, Serrano and Weprin Whereas, State and City employees who abuse their office or position have damaged the public trust and therefore should not be entitled to receive a retirement allowance; and Whereas, If members of a public retirement system are convicted of or plead guilty to a criminal offense relating to their performance or failure to perform official duties and responsibilities, such members should forfeit their rights to the publicly funded portion of their retirement benefits; and Whereas, Pension forfeiture for criminal conduct is necessary to preserve the trust placed in public servants, to promote public confidence in government and to protect the integrity of government decision-making; now, therefore, be it Resolved, That the Council of the City of New York calls upon the New York State Legislature to revise the State Retirement and Social Security law to ensure that all State and City employees who are hired in the future who are later convicted of or plead guilty to serious criminal conduct in connection with their State or City employment will be prohibited from collecting the publicly funded portion of their pension, or, alternatively, to grant the City the authority to enact legislation prohibiting City employees who are hired in the future who are later convicted of or plead guilty to serious criminal conduct in connection with their City employment from collecting the publicly funded portion of their pension.
