THE COUNCIL OF THE CITY OF NEW YORK RESOLUTION NO. 926 Title Resolution approving the decision of the City Planning Commission on Application No. N 030277 ZRQ, an amendment to the text of the Zoning Resolution regarding Section 117-422 (Sign regulations), within the Court Square Subdistrict of the Special Long Island City Mixed-Use District, relating to non-conforming signs, Queens (L.U. No. 434). Body By Council Members Katz and Avella WHEREAS, the City Planning Commission filed with the Council on April 28, 2003 its decision dated April 23, 2003 (the "Decision"), on the application submitted by Citibank, N.A., pursuant to Section 201 of the New York City Charter, for an amendment to the text of the Zoning Resolution (Application No. N 030277 ZRQ) (the "Application"); WHEREAS, the Decision is subject to review and action by the Council pursuant to Section 197-d(b)(1) of the City Charter; WHEREAS, upon due notice, the Council held a public hearing on the Decision and Application on May 20, 2003; WHEREAS, the Council has considered the land use implications and other policy issues relating to the Decision and Application; and WHEREAS, the Council has considered the relevant environmental issues and the Negative Declaration, issued on January 21, 2003 (CEQR No. 03DCP032Q); RESOLVED: The Council finds that the action described herein will have no significant effect on the environment; Pursuant to Sections 197-d and 200 of the City Charter and on the basis of the Decision and Application the Council approves the Decision; and The Zoning Resolution of the City of New York, effective as of December 15, 1961, and as subsequently amended, is further amended as follows: _________ Matter in Greytone is new, to be added; Matter in Strikeout is old, to be deleted; Matter within # # is defined in Section 12-10; * * * indicate where unchanged text appears in the Zoning Resolution. 7/26/01 117-422 Sign regulations All requirements of Section 32-60 (SIGN REGULATIONS) shall apply except for Sections 32-642 (Non-illuminated signs), 32-644 (Illuminated or flashing signs in C4, C5-4, C6 or C7 Districts) and 32-655 (Height of signs in all other Commercial Districts). Non-#illuminated#, #illuminated# or #flashing signs# are permitted with a total #surface area# (in square feet) not exceeding five times the #street# frontage of the #zoning lot#, in feet, but in no event shall the total #surface area# exceed 500 square feet for #interior# or #through lots# or 500 square feet on each frontage for #corner lots#. No permitted #sign# shall extend above #curb level# at a height greater than 60 feet. A #non-conforming sign# may be replaced pursuant to Section 52-82 (Non-Conforming Signs other than Advertising Signs), except that the height, location or position of the replacement #sign# may be changed by up to 10 feet, measured from the perimeter of the original #non-conforming sign#.
