Title
Resolution approving with modifications the decision of the City Planning Commission on ULURP No. C 030158 PSK (L.U. No. 412), site selection of property located at 165 Cadman Plaza East (Block 85/ Lot 6), Brooklyn, for use as an office and emergency operations center.

WHEREAS, the City Planning Commission filed with the Council on March 20, 2003 its decision dated March 19, 2003 (the "Decision") on the application submitted pursuant to Section 197-c of the New York City Charter by the Department of Citywide Administrative Services and the Office of Emergency Management for site selection of property located at 165 Cadman Plaza East (Block 85/Lot 6), Community District 2, Borough of Brooklyn (the "Site"), for use as an office and emergency operations center (ULURP No. C 030158 PSK) (the "Application");
WHEREAS, the Decision is subject to review and action by the Council pursuant to Section 197-d(b)(3) of the City Charter;
WHEREAS, upon due notice, the Council held a public hearing on the Decision and Application on April 28, 2003;
WHEREAS, the Council has considered the relevant environmental issues and the Negative Declaration, issued on October 9, 2002 (CEQR Number 03OEM001K); and
WHEREAS, the Council has considered the land use implications and other policy issues relating to the Decision and Application;
RESOLVED:
The Council finds that the action described herein will have no significant effect on the environment.

Pursuant to Section 197-d of the City Charter and on the basis of the Application and Decision, the Council approves the Decision with the following modifications:
1) No fuel storage tanks shall be located on the site. This modification shall not apply to fuel tanks used for on-site back-up power generation purposes which, either alone or in combination, have a capacity of eight thousand (8,000) gallons or less.
2) No part of the structure or appurtenance shall encroach on mapped parkland adjacent
to the site.
3) All accessory parking shall be on the site.
