A Local Law to amend the administrative code of the city of New York, in relation to requirements for window guards on fire escape windows.

 

 

Be it enacted by the Council as follows:

 

Section 1. Chapter one of title 17 of the administrative code of the city of New York is amended by adding a new section 17-124 to read as follows:

                     §17-124. Window guards on fire escape windows. Notwithstanding any other local law or regulation, the owner, lessee, agent or other person who manages or controls a multiple dwelling shall provide, install, and maintain, a window guard, of a type deemed acceptable by the fire commissioner, on the windows of each apartment in which a child or children ten (10) years of age and under reside, and on the windows, if any, in the public halls of a multiple dwelling in which such children reside.

§2. Any person who violates the provisions of this section, or the regulations promulgated hereunder, shall be guilty of a misdemeanor punishable by a fine of up to five hundred dollars or imprisonment for up to six months or both. In addition, any violation of this section shall constitute a civil violation subject to a penalty of not more than five hundred dollars per violation.

§3. This local law shall take effect 30 days after its enactment.
