THE COUNCIL OF THE CITY OF NEW YORK RESOLUTION NO. 641 Title Resolution approving the decision of the City Planning Commission on ULURP No. M 770445 (C) ZMK, the modification of Restrictive Declaration D-47 (the 1979 Declaration) and its subsequent amendments (M 770445 (A) ZMK and M 770445 (B) ZMK), for a commercial development on property located southeasterly of the intersection of Flatlands Avenue and Louisiana Avenue (Block 8235/Lots 48 and 53) in an R5/C2-1 District and an R5/C2-2 District, Brooklyn (L.U. No. 325). Body By Council Members Katz and Avella WHEREAS, the City Planning Commission filed with the Council on November 26, 2002 its decision dated November 20, 2002 (the "Decision"), on the application submitted by Sheradel Assoicates, for the modification of Restrictive Declaration D-47 (the 1979 Declaration), for the property located southeasterly of the intersection of Flatlands Avenue and Louisiana Avenue (Block 8235/Lots 48 and 53), in an R5/C2-1 District and an R5/C2-2 District, Community District 18, Borough of Brooklyn, in connection with an amendment to the Zoning Map (ULURP No. M 770445 (C) ZMK) (the "Application"); WHEREAS, the Decision is subject to review and action by the Council pursuant to Section 197-d(b)(1) of the City Charter; WHEREAS, the subject application is a request by Sheradel Associates to modify Restrictive Declaration D-47 (the 1979 Declaration) as it relates to the subject property so as to permit a commercial development; WHEREAS, upon due notice, the Council held a public hearing on the Decision and Application on December 10, 2002; and WHEREAS, the Council has considered the land use implications and other policy issues relating to the Decision and Application.
