Res. No. 441 Title Resolution pursuant to Section 19-511.1 of the Administrative Code of the City of New York to review twenty-one determinations by the Taxi and Limousine Commission to approve applications for the renewal of a license to operate a base station and six determinations by the Taxi and Limousine Commission to approve applications for new licenses to operate a base station. Body By Council Members Liu and Comrie; also Council Member Vann Whereas, Subdivision (g) of section 19-511 of the Administrative Code of the City of New York provides that upon receiving an application for the issuance of a license for a new base station or for the renewal of a license for a base station, the Taxi and Limousine Commission (TLC) shall, within five business days, submit a copy of such application to the Council and to the district office of the Council Member and the Community Board for the area in which the base station is or would be located; and, Whereas, Section 19-511.1 of the Administrative Code provides that any determination by TLC to approve an application for a license to operate a new base station or to renew a license to operate a base station shall be subject to review by the Council; and, Whereas, Within ninety days of the first Stated Meeting following receipt of such determination and its accompanying materials, the Council may approve or disapprove such determination by local law, after having adopted a resolution to review that determination; and, Whereas, Should the Council not timely adopt a resolution to review the TLC's determination or, having done so, not timely pass a local law with respect to such determination, the approval by TLC of an application to operate a new base station or for renewal of a license to operate a base station shall remain in effect; and, Whereas, The Taxi and Limousine Commission made determinations to approve twenty-one applications for renewal of a base station license that were submitted to the Council as Communications by the Mayor numbers M-125, M-126, M-128, M-129, M-156, M-157, M-158, and M-160 through M-174; and, Whereas, These determinations were made with respect to the applications of Rizz Management, Inc. also known as Rizz Management Inc. doing business as Aviv-Express Car & Limo Service; New American Car & Limousine Serivice Inc. also known as New American Car & Limo. Svc. also known as New American Car & Limousine Service, Inc.; Mauser Service, Inc. d/b/a Nu Nu Car Service; Caprice Car Service No. 2, Inc. also known as Caprice Car Service No. 2 Inc.; Arecibo Car Service Inc. also known as Arecibo Car Service, Inc.; 3472 Miles, Inc. doing business as Miles Private Car Service; The New Brooklyn Car Service, Inc. also known as The New Brooklyn Car Service Inc.; Keshet Car Service Ltd.; Fordham Uno Corp.; Joe M Leasing Corporation also known as Joe M. Yes Car Service, Inc. doing business as Yes Car Service; Golden Express Car Service; JSE Management Corp. doing business as Dial A Ride; and, Whereas, The Taxi and Limousine Commission made six determinations to approve applications for a license to operate a new base station that were submitted to the Council as Communications by the Mayor number M-80 and numbers M-84 through M-88; and Whereas, The determinations for new licenses to operate a base station were made with respect to the application by the Trans Union Car Service; Taka Car Service; Bon Afriques Ventures Inc. doing business as Bronx Car Service 1 also known as Bronx Car Service One; Easy Fast Car Service; 4-T Car Service; and C&D Car Service, Inc.; and Whereas, The first Stated Meeting subsequent to receipt of the submission of Trans Union Car Service was held on May 9, 2002; and Whereas, The first Stated Meeting subsequent to receipt of the other submissions was held on May 21, 2002 now, therefore, be it Resolved, That the Council hereby invokes its authority pursuant to Section 19-511.1 of the Administrative Code of the City of New York to review twenty-one determinations by the Taxi and Limousine Commission to approve applications for the renewal of a license to operate a base station and six determinations by the Taxi and Limousine Commission to approve applications for new licenses to operate a base station.
