Resolution approving the decision of the City Planning Commission on ULURP No. C 010091 ZSQ (L.U. No. 218), grant of a special permit pursuant to Sections 74-90 and 74-902 of the Zoning Resolution to allow the enlargement of an existing nursing home.

WHEREAS, the City Planning Commission filed with the Council on June 28, 2002 its decision dated June 26, 2002 (the "Decision") on the application submitted by the Waterview Nursing Care Center, Inc., pursuant to Sections 197-c and 201 of the New York City Charter, for the grant of a special permit pursuant to Section 74-90 of the Zoning Resolution to permit the enlargement of an existing nursing home and Section 74-902 to permit the allowable community facility floor area ratio of Section 24-11 (Maximum Floor Area and Percentage of Lot Coverage) to apply to a proposed approximately 55,029 square foot enlargement of an existing nursing home with an increase in the total number of beds from 200 to 239 on property located at 119-15 27th Avenue (Block 4291/Lot 20) in an R4 District, Community District 7, Borough of Queens (ULURP No. C 010091 ZSQ) (the "Application");
WHEREAS, the City Planning Commission has made the findings required pursuant to Sections 74-90 and 74-902 of the Zoning Resolution;
WHEREAS, the Decision is subject to review and action by the Council pursuant to Section 197-d(b)(3) of the City Charter;
WHEREAS, upon due notice, the Council held a public hearing on August 7, 2002 on the Decision and Application;
WHEREAS, the Council has considered the relevant environmental issues and the Conditional Negative Declaration, issued on March 4, 2002 (CEQR No. 00DCP029Q); and
WHEREAS, the Council has considered the land use implications and other policy issues relating to the Decision and Application;

RESOLVED:
Pursuant to Sections 197-d and 200 of the New York City Charter and on the basis of the Decision and Application, the Council approves the Decision.
