THE COUNCIL OF THE CITY OF NEW YORK RESOLUTION NO. 167 Title Resolution approving the decision of the City Planning Commission on ULURP No. C 020084 ZSM (L.U. No. 122), grant of a special permit to allow modification of the regulations of Sections 42-14D(2)(b) and 42-14D(1)(b) of the Zoning Resolution. Body By Council Members Katz and Avella WHEREAS, the City Planning Commission filed with the Council on February 26, 2002 its decision dated February 20, 2002 (the "Decision") on the application submitted by Red Tulip, L.L.C, pursuant to Sections 197-c and 201 of the New York City Charter, for the grant of a special permit pursuant to the following sections of the Zoning Resolution: Section 74-781 to modify the use regulations of Section 42-14(D)(2)(b) to allow retail uses (Use Group 6A) on the ground floor and in the cellar; and Section 74-782 to modify the use regulations of Section 42-14(D)(1)(b) to allow joint living-work quarters for artists on the second through fifth floors of an existing 5-story building with lot coverage greater than 5000 square feet located at 419-421 Broome Street (Block 473/Lot 36), in an M1-5B District, Community District 2, Borough of Manhattan (ULURP No. C 020084 ZSM) (the "Application"); WHEREAS, the City Planning Commission has made the findings required pursuant to Sections 74-781 and 74-782 of the Zoning Resolution; WHEREAS, the Decision is subject to review and action by the Council pursuant to Section 197-d(b)(3) of the City Charter; WHEREAS, upon due notice, the Council held a public hearing on March 19, 2002 on the Decision and Application; WHEREAS, the Council has considered the land use implications and other policy issues relating to the Decision and Application; RESOLVED: The Council finds that the action described herein will have no significant effect on the environment; and ________ Page 2 of 2 C 020084 ZSM Reso.
