THE COUNCIL OF THE CITY OF NEW YORK RESOLUTION NO. 82 Title Resolution approving the decision of the City Planning Commission on ULURP No. C 010472 ZSX (L.U. No. 80), grant of a special permit to allow the enlargement of an existing 480-bed nursing home. Body By Council Members Katz and Avella WHEREAS, the City Planning Commission filed with the Council on January 29, 2002 its decision dated January 23, 2002 (the "Decision") on the application submitted by the Bronx Harbor Health Care Complex, Inc., pursuant to Sections 197-c and 201 of the New York City Charter, for the grant of a special permit pursuant to Section 74-90 of the Zoning Resolution to permit an approximately 57,485 square foot enlargement without an increase of the number of beds of an existing 480-bed nursing home on a zoning lot bounded by Waring Avenue, Gun Hill Road, Stillwell Avenue, and Ely Avenue (Block 4423, Lot 1), in an R6 District, Community District 11, Borough of the Bronx (ULURP No. C 010472 ZSX) (the "Application"); WHEREAS, the Application is related to ULURP Applications Nos. C 010471 ZMX (L.U. No. 79), an amendment to the Zoning Map, and C 010473 ZSX (L.U. No. 81), a special permit pursuant to Section 74-90 of the Zoning Resolution; WHEREAS, the City Planning Commission has made the findings required pursuant to Section 74-90 of the Zoning Resolution; WHEREAS, the Decision is subject to review and action by the Council pursuant to Section 197-d(b)(3) of the City Charter; WHEREAS, upon due notice, the Council held a public hearing on February 12, 2002 on the Decision and Application; WHEREAS, the Council has considered the relevant environmental issues and the Negative Declaration, issued on October 9, 2001 (CEQR No. 01DCP047X); and WHEREAS, the Council has considered the land use implications and other policy issues relating to the Decision and Application. ________ Page 2 of 2 C 010472 ZSX Reso. No. 80) RESOLVED: The Council finds that the action described herein will have no significant effect on the environment; and Pursuant to Sections 197-d and 200 of the New York City Charter and on the basis of the Decision and Application, the Council approves the Decision.
