THE COUNCIL OF THE CITY OF NEW YORK RESOLUTION NO. 33 Title Resolution approving the decision of the City Planning Commission on ULURP No. C 020049 ZSK (L.U. No. 65), grant of a special permit pursuant to Section 74-922 of the Zoning Resolution to allow a food store with more than 10,000 square feet in an M1-1/R5 District. Body By Council Members Katz and Avella WHEREAS, the City Planning Commission filed with the Council on January 3, 2002 its decision dated December 19, 2001 (the "Decision") on the application submitted by the Economic Development Corporation and the Beard Street Warehouse, Inc., pursuant to Sections 197-c and 201 of the New York City Charter, for the grant of a special permit pursuant to Section 74-922 of the Zoning Resolution to permit a food store (U.G. 6A) with more than 10,000 square feet of floor area (Block 611/Lots 6 and 11) and its off-site accessory parking lot (Block 611, Lots 1 and 55) on properties generally bounded by Conover Street, Reed Street, Van Brunt Street, and the U.S. Bulkhead Line, in an M1-1/R5 District, within the Special Mixed Use District MX-5, Borough of Brooklyn (ULURP No. C 020049 ZSK) (the "Application"); WHEREAS, the Application is related to ULURP Applications C 020046 ZRK (L.U. No. 63), an amendment to the text of the Zoning Resolution; C 020047 ZMK (L.U. No. 62), an amendment to the Zoning Map; and C 020048 PPK (L.U. No. 64), disposition of city-owned property; WHEREAS, the City Planning Commission has made the findings required pursuant to Section 74-922 of the Zoning Resolution; WHEREAS, the Decision is subject to review and action by the Council pursuant to Section 197-d(b)(3) of the City Charter; WHEREAS, upon due notice, the Council held a public hearing on January 25, 2002 on the Decision and Application; WHEREAS, the Council has considered the relevant environmental issues and the Negative Declaration, issued on August 9, 2001 (CEQR No. 00DME013); and _________ Page 2 of 2 C 020049 ZSK Reso. No. 65) WHEREAS, the Council has considered the land use implications and other policy issues relating to the Decision and Application; RESOLVED: The Council finds that the action described herein will have no significant effect on the environment; and Pursuant to Sections 197-d and 200 of the New York City Charter and on the basis of the Decision and Application, the Council approves the Decision.
