THE COUNCIL OF THE CITY OF NEW YORK RESOLUTION NO. 2179 Title Resolution approving the decision of the City Planning Commission on ULURP No. C 010709 ZMM, a Zoning Map change (L.U. No. 1271). Body By Council Members Eisland and McCaffrey WHEREAS, the City Planning Commission filed with the Council on November 28, 2001 its decision dated November 21, 2001(the "Decision"), on the application submitted by New York University School of Medicine and the Economic Development Corporation, pursuant to Sections 197-c and 201 of the New York City Charter, for an amendment to the Zoning Map (ULURP No. C 010709 ZMM) (the "Application"); WHEREAS, the Application is related to Applications Number 20025129 HHM (L.U. No. 1283), for the surrender of land and buildings; C 010708 PPM (L.U. No. 1270), disposition of city-owned property; C 010712 ZSM (L.U. No. 1272), a special permit pursuant to Section 74-48 of the Zoning Resolution; and C 010713 ZSM (L.U. No. 1273), special permit pursuant to Section 13-561 of the Zoning Resolution; WHEREAS, the Decision is subject to review and action by the Council pursuant to Section 197-d(b)(1) of the City Charter; WHEREAS, upon due notice, the Council held a public hearing on the Decision and Application on December 13, 2001; WHEREAS, the Council has considered the land use implications and other policy issues relating to the Decision and Application; and WHEREAS, the Council has considered the relevant environmental issues and the Final Environmental Impact Statement ("FEIS") for which a Notice of Completion was issued on November 9, 2001 (CEQR No. 01DME004M); and RESOLVED: ___________ Page 2 of 3 C 010709 ZMM Reso. No. 2179 (L.U. No. 1271) Having considered the FEIS, with respect to the Application, the Council finds that: (1) The FEIS meets the requirements of 6 N.Y.C.R.R. Part 617; (2) From among the reasonable alternatives thereto, the actions to be approved are ones which minimize or avoid adverse environmental impacts to the maximum extent practicable; and (3) The adverse environmental impacts revealed in the FEIS will be minimized or avoided to the maximum extent possible by incorporating as conditions to the approval those mitigative measures that were identified as practicable; (4) The Decision and the FEIS constitute the written statement of facts, and of social, economic and other factors and standards that form the basis of this determination, pursuant to 6 N.Y.C.R.R. ยง617.9(c)(3). Pursuant to Sections 197-d and 200 of the City Charter and on the basis of the Decision and Application, the Council approves the Decision. The Zoning Resolution of the City of New York, effective as of December 15, 1961, and as subsequently amended, is further amended by changing the Zoning Map, Section No. 8d: 1. eliminating from an existing R8 District a C2-5 District bounded by the easterly prolongation of the southerly street line of East 30th Street, a line 150 feet easterly of First Avenue, the easterly prolongation of the southerly street line of East 29th Street, and First Avenue; and 2. changing from an R8 District to a C6-2 District, property bounded by the easterly prolongation of the southerly street line of East 29th Street, a line 150 feet easterly of First Avenue, a line 105 feet southerly of the easterly prolongation of the southerly street line of East 29th Street, a line 525 feet easterly of First Avenue, a line 180 feet southerly of the easterly prolongation of the southerly street line of East 29th Street, Franklin D. Roosevelt Drive, the center line of the elevated portion of Franklin D. Roosevelt Drive located within Marginal Street Wharf or Place, a line 310 feet northerly of the easterly prolongation of the southerly street line of East 29th Street, and First Avenue; ____________ Page 3 of 3 C 010709 ZMM Reso.
