THE COUNCIL OF THE CITY OF NEW YORK RESOLUTION NO. 2052 Title Resolution disapproving the decision of the City Planning Commission on ULURP No. C 010304 ZSM (L.U. No. 1152), a special permit pursuant to Section 74-781 of the Zoning Resolution to modify the use regulations of Section 42-14D(2)(b) to allow Use Group 6 in an existing 6-story building. Body By Council Members Eisland and McCaffrey WHEREAS, the City Planning Commission filed with the Council on July 17, 2001 its decision dated July 11, 2001 (the "Decision") on the application submitted by Cooper Square Associates Limited Partnership, pursuant to Sections 197-c and 201 of the New York City Charter, for the grant of a special permit pursuant to Section 74-781 of the Zoning Resolution to permit the modification of the use regulations of Section 42-14D(2)(b) to allow retail uses (Use Group 6) on the ground floor and in the cellar of an existing 6-story building located at 32 Cooper Square (Block 544/Lot 38), in an M1-5B District, within the NoHo Historic District, Borough of Manhattan (ULURP No. C 010304 ZSM) (the "Application"); WHEREAS, the City Planning Commission has made the findings required pursuant to Section 74-781 of the Zoning Resolution; WHEREAS, the Decision is subject to review and action by the Council pursuant to Section 197-d(b)(3) of the City Charter; WHEREAS, upon due notice, the Council held a public hearing on August 21, 2001 on the Decision and Application; WHEREAS, the Council has considered the land use implications and other policy issues relating to the Decision and Application; RESOLVED: ________ Page 2 of 2 C 010304 ZSM Reso. No. 1152) The Council finds that the action described herein will have no significant effect on the environment; and Pursuant to Sections 197-d and 200 of the New York City Charter and on the basis of the Decision and Application, the Council disapproves the Decision.
