THE COUNCIL OF THE CITY OF NEW YORK RESOLUTION NO. 1995 Title Resolution approving the petition for a revocable consent for an unenclosed sidewalk café located at 30-95 33rd Street, Queens (20015149 TCQ; L.U. No. 1123). Body By Council Members Eisland and McCaffrey WHEREAS, the Department of Transportation filed with the Council on May 31, 2001 its approval of the petition of Krilic Enterprises, Inc., d/b/a Brick Café (the "Applicant"), for a revocable consent to modify and continue to maintain and operate an unenclosed sidewalk café located at 30-95 33rd Street, Borough of Queens (the "Petition"), pursuant to Section 20-226 of the New York City Administrative Code (the "Administrative Code"); WHEREAS, the Petition is subject to review by the Council pursuant to Section 20-226(g) of the Administrative Code; WHEREAS, upon due notice, the Council held a public hearing on the Petition on June 20, 2001, recessed until June 26, 2001 and recessed until June 28, 2001; WHEREAS, in testimony and by letter dated June 22, 2001, the Applicant has stipulated that: 1. The license will be for four (4) tables and sixteen (16) chairs; 2. The tables will be located only on the sidewalk on the right side of the entrance; 3. A bottom weighted railing, not to exceed 30 inches in height, and a minimum of eight feet from the curb will be utilized; 4. No planters will be installed; and 5. The license will be voluntarily surrendered if the Applicant receives a violation pertaining to excess tables and/or chairs or the placement of the railing. _______ Page 2 of 2 20015149 TCQ Reso.
