THE COUNCIL OF THE CITY OF NEW YORK RESOLUTION NO. 1895 Title Resolution approving the site plan for Public School/Intermediate School (P.S./I.S. 395-Brooklyn), to be located at 4502 Farragut Road, East Flatbush, Brooklyn (Non-ULURP No. 20015122 SCK; L.U. No. 1061) Body By Council Members Eisland and Sabini WHEREAS, the New York City School Construction Authority submitted to the Council on November 16, 2000, a site plan pursuant to Section 1732 of the New York State Public Authorities Law for a public school facility known as P.S./I.S. 395-K, with a capacity of up to 1,098 seats to serve pre-kindergarten through eighth grades, Community School District 22, to be located at 4502 Farragut Road, East Flatbush (Block 5022/Lot 2 in portion), Borough of Brooklyn (the "Site Plan"); WHEREAS, the Site Plan is subject to review and action by the Council pursuant to Section 1732 of the New York State Public Authorities Law; WHEREAS, upon due notice, the Council held a public hearing on the Site Plan on April 18, 2001; WHEREAS, the Council has considered the relevant environmental issues and the Final Environmental Impact Statement ("FEIS"), for which a Notice of Completion was issued on March 29, 2001 (SCA Project Number 00-023); and WHEREAS, the Council has considered the land use implications and other policy issues relating to the Site Plan; RESOLVED: Having considered the FEIS, with respect to the Application, the Council finds that: (1) The FEIS meets the requirements of 6 N.Y.C.R.R. Part 617; __________ Page 2 of 2 20015122 SCK Reso. No. 1895 (L.U. No. 1061) (2) From among the reasonable alternatives thereto, the actions to be approved are ones which minimize or avoid adverse environmental impacts to the maximum extent practicable; and (3) The adverse environmental impacts revealed in the FEIS will be minimized or avoided to the maximum extent possible by incorporating as conditions to the approval those mitigative measures that were identified as practicable; (4) The Decision and the FEIS constitute the written statement of facts, and of social, economic and other factors and standards that form the basis of this determination, pursuant to 6 N.Y.C.R.R. ?617. Pursuant to Section 1732 of the Public Authorities Law, the Council approves the Site Plan. Adopted.
