THE COUNCIL OF THE CITY OF NEW YORK RESOLUTION NO. 1757 Title Resolution approving the decision of the City Planning Commission on an application submitted by the Department of Housing Preservation and Development, ULURP No. C 000547 HAM, approving the designation of Site 123A - 143, 145, 147, 149, 151 Malcolm X Boulevard (Block 1902/Lots 29, 30, 31, 32, 33); Site 123C - 111 W. 117th Street (Block 1902/Lot 25); Site 123D - 113 W. 117th Street (Block 1902/Lot 124); Site 124 - 131 Malcolm X Boulevard (Block 1901/Lot 33); and Site 124 - 100 W. 117th Street (Block 1901/Lot 36), Manhattan, as an Urban Development Action Area, approving the project for the area as an Urban Development Action Area Project, and approving the disposition of such property to a developer selected by the Department of Housing Preservation and Development and approving the disposition of Site 123B - 107 W. 117th Street (Block 1902/Lot 126) and Site 123E - 141 W. 117th Street (Block 1902/Lot 13) to a sponsor/developer to be selected by HPD (L.U. No. 880; C 000547 HAM). Body By Council Members Eisland and Linares WHEREAS, the City Planning Commission filed with the Council on January 8, 2001 its decision dated December 27, 2000 (the "Decision"), on the application submitted by the Department of Housing Preservation and Development pursuant to Section 197-c of the New York City Charter and Article 16 of the General Municipal Law of New York State regarding: a) the designation of the following properties as an Urban Development Action Area (the "Area"): Site Block Lot Address 123A 1902 29 143 Malcolm X Boulevard 123A 1902 30 145 Malcolm X Boulevard 123A 1902 31 147 Malcolm X Boulevard 123A 1902 32 149 Malcolm X Boulevard 123A 1902 33 151 Malcolm X Boulevard 123C 1902 25 111 W. 117th Street 123D 1902 124 113 W. 117th Street Page 2 of 3 C 000547 HAM Reso. No. 880) 124 1901 33 131 Malcolm X Boulevard 124 1901 36 100 W. 117th Street b) an Urban Development Action Area Project for such area (the "Project"); c) pursuant to Section 197-c of the New York City Charter for the disposition of Site 123B - 107 W. 117th Street (Block 1902/Lot 126) and Site 123E - 141 W. 117th Street (Block 1902/Lot 13) to a developer/sponsor to be selected by the Department of Housing Preservation and Development (ULURP No. C 000547 HAM) (the "Application"); WHEREAS, the Application is related to ULURP Application Numbers C 000544 HUM (L.U. No. 878) and C 000546 HUM (L.U. No. 546), urban renewal plan amendments; WHEREAS, the Decision is subject to review and action by the Council pursuant to Section 197-d(b)(1) of the City Charter; WHEREAS, the Application and Decision are subject to review and action by the Council pursuant to Article 16 of the General Municipal Law of New York State; WHEREAS, on January 30, 2001 the New York City Department of Housing Preservation and Development ("HPD") submitted to the Council its recommendations regarding the Application dated January 23, 2001; WHEREAS, upon due notice, the Council held a public hearing on the Application and Decision on February 1, 2001; WHEREAS, the Council has considered the relevant environmental review (CEQR No. 99HPD001M) and the fact that a Negative Declaration was issued on November 10, 1998; WHEREAS, the Council has considered the land use and financial implications and other policy issues relating to the Application; RESOLVED: _________ Page 3 of 3 C 000547 HAM Reso. No. 880) The Council finds that the actions described herein will have no significant effect on the environment; Pursuant to Section 197-d, the Council approves the decision of the City Planning Commission (C 000547 HAM). The Council finds that the present status of the Disposition Area tends to impair or arrest the sound growth and development of the City of New York and that a designation of the Project as an urban development action area project is consistent with the policy and purposes stated in Section 691 of the General Municipal Law. The Council approves the designation of the Disposition Area as an urban development action area pursuant to Section 693 of the General Municipal Law. The Council approves the Project as an urban development action area project pursuant to Section 694 of the General Municipal Law. The Council approves the disposition of said property to a developer selected by the Department of Housing Preservation and Development. Adopted.
