Resolution calling upon the New York State Legislature to amend the Criminal Procedure Law to include New York City Traffic Enforcement Agents as peace officers.

By Council Members McCaffrey, Berman, Malave-Dilan, Foster, Marshall and White; also Council Members Harrison, Koslowitz, Lasher, O'Donovan, Pinkett, Robinson and Watkins
Whereas, Traffic Enforcement Agents are responsible for issuing traffic summonses and enforcing various sections of the Vehicle and Traffic Law of the State of New York; and
Whereas, In the performance of these duties, Traffic Enforcement Agents exercise an important law enforcement function in this City, thus adding to the quality of life enjoyed by all New Yorkers; and
Whereas, The New York State Legislature, in Criminal Procedure Law § 2.20, sets forth the powers of peace officers; and
Whereas, Criminal Procedure Law § 2.10 delineates the individuals deemed peace officers under New York State law, which includes those individuals who are special patrolmen under subdivisions c and e of § 14-106 of the Administrative Code of the City of New York; and
Whereas, The nature of the work performed by Traffic Enforcement Agents, in its law enforcement and quality of life enhancing aspects, warrants the designation of peace officer; and
Whereas, By deeming Traffic Enforcement Agents peace officers, the State Legislature will accord Traffic Enforcement Agents the power and recognition they deserve; now, therefore, be it
Resolved, That the Council of the City of New York calls upon the New York State Legislature to amend the Criminal Procedure Law to include Traffic Enforcement Agents as peace officers.
