Res. No. 1035 Title Resolution calling upon all members of the New York State Congressional delegation to reject H.R. 1032, which would prohibit certain causes of action against gun manufacturers. Body By Council Members Fisher, DiBrienza, Eisland and Rodriguez; also Council Members Harrison, Koslowitz, McCaffrey, michels, Nelson, O'Donovan, Quinn and Rivera. Whereas, Gun violence is a serious concern in all American cities, including New York City; and Whereas, According to the Fiscal 1999 Mayor's Management Report, there were 2, 118 reported shooting victims in Fiscal 1998 and 2,009 reported shooting victims in Fiscal 1999; and Whereas, According to data compiled by the Department of Health, there were 486 deaths by firearms in 1997, 483 of which were deemed homicides; and Whereas, Gun violence has exacted a heavy human toll in this City and gun makers should be held responsible for the damages caused by their products; and Whereas, Several cities in the United States have brought suits or are preparing to file suits against gun manufacturers alleging that they have intentionally or negligently either marketed or distributed weapons; and Whereas, Citizens and municipalities have the right to use the Court system to seek redress and should not be barred by political means from using this system; and Whereas, It should be within the Courts' jurisdiction to determine the validity of such lawsuits; and Whereas, H.R. 1032, the Firearms Heritage Protection Act of 1999, would limit this right by prohibiting civil actions from being brought by individuals or governmental entities, such as the City of New York, against manufacturers of firearms for damages resulting from the misuse of their products by others; now, therefore, be it Resolved, That the Council of the City of New York calls upon the members of the New York State Congressional delegation to reject H.R. 1032, which prohibits certain types of lawsuits against gun manufacturers.
