Resolution calling upon the appropriate committee of the Council to hold a hearing on the issue of service guarantees in City contracts to assure that electric current will be provided to streetlights and calling upon City agencies to vigorously enforce any existing provisions in its contracts to ensure uninterrupted electric service to streetlights and to modify those contracts to better ensure such electric service.

By Council Members Boyland, McCaffrey, Rivera, DiBrienza, Espada, Freed, Koslowitz, Lopez, Marshall, Nelson, Perkins, Reed, Rodriquez, Warden, Abel and Stabile; also Council Members Harrison, Leffler, Linares, O'Donovan, Pinkett and Povman.
Whereas, The City of New York has contracts for the provision of electricity to streetlights; and
Whereas, The City pays the New York Power Authority (NYPA) a flat rate for generation and provision of electricity to those streetlights and Consolidated Edison (Con Ed) collects forty percent of that fee from NYPA for transmission of current and the performance of services such as meter readings, billings, etc; and
Whereas, As of May 26, 1999 more than 1100 streetlights in New York City were not receiving current: 330 in Brooklyn, 305 in Manhattan, 263 in Queens, 214 in The Bronx and 28 in Staten Island, some for as long as six months; and
Whereas, If a power problem, rather than a mechanical problem, develops in a streetlight the Department of Transportation will "stop tag" the light and inform Con Ed of the power outage and it then becomes Con Ed's duty to restore current to the streetlight; and
Whereas, Under section 333 of the New York City Charter, each agency that lets contracts is required to monitor the performance of every contractor and possesses the authority to take the necessary action with respect to contract non-compliance; and
Whereas, In numerous cases Con Ed has not fulfilled its duty to restore current to streetlights and the City has not effectively or adequately enforced its contracts with NYPA and Con Ed; now, therefore; be it
Resolved, That the appropriate committee of the Council hold a hearing on the issue of service guarantees in City contracts to assure that electric current will be provided to streetlights and calling upon City agencies to vigorously enforce any existing provisions in its contracts to ensure uninterrupted electric service to streetlights and to modify those contracts to better ensure such electric service.
