Title: A Local Law to amend the administrative code of the city of New York, in relation to online access to video of alleged red light camera and speed camera violations

Summary: This local law would require the Transportation Commissioner, in consultation with the Finance Commissioner, to establish secure websites that allow the owner of a vehicle who has received a notice of liability for a speed or red light camera violation to view video of the alleged violation. Additionally, the notice of liability for such violations would be required to include the address of the website and a unique identifier that permits the vehicle owner to access the website to view the video.

A Local Law to amend the administrative code of the city of New York, in relation to online access to video of alleged red light camera and speed camera violations

 

Be it enacted by the Council as follows:

 

Section 1. Subchapter 3 of chapter 1 of title 19 of the administrative code of the city of New York is amended by adding a new section 19-177.1 to read as follows:

§19-177.1 Video of speed camera violations. a. For purposes of this section, the term “photo speed violation monitoring system” means a vehicle sensor installed by the department as described in subdivision c of section eleven hundred eighty-b of the vehicle and traffic law.

b. The commissioner, in consultation with the commissioner of finance, shall establish a secure website that permits the owner of a vehicle who has received a notice of liability pursuant to section eleven hundred eighty-b of the vehicle and traffic law to view video produced by a photo speed violation monitoring system of the alleged violation contained in such notice. Such notice of liability shall contain the address of the website established pursuant to this section and a unique identifier that permits the owner to access such website to view a video of the alleged violation.

§2. Chapter 2 of title 19 of the administrative code of the city of New York is amended by adding a new section 19-210.1 to read as follows:

§19-210.1 Video of traffic-control violations. a. The commissioner, in consultation with the commissioner of finance, shall establish a secure website that permits the owner of a vehicle who has received a notice of liability pursuant to section 19-210 to view video produced by a traffic-control signal photo violation-monitoring system of the alleged violation contained in such notice. Such notice of liability shall also contain the address of the website established pursuant to this section and a unique identifier that permits the owner to access such website to view a video of the violation.

§3. This law takes effect 90 days after becoming law.
