A Local Law to amend the administrative code of the city of New York, in relation to the dispensing of prescription drugs.
 
 
Be it enacted by the Council as follows:
 
      Section 1.  Chapter one of title 17 of the administrative code of the city of New York is amended by adding a new section 17-179 to read as follows:
      §17-179.  Dispensing of prescription drugs.  a. Any drug which is required to be dispensed by filling or refilling a written or an oral prescription of a qualified medical practitioner shall bear on the label of its container a control number clearly printed thereon by the manufacturer or packer.
      b.      Any drug which is required to be dispensed by filling or refilling a written or an oral prescription of a qualified medical practitioner shall not be removed from its container for sale except by a pharmacist, or by a pharmacy intern or other employee or agent under the control and supervision of a pharmacist.
      c.      Pharmacists responsible for dispensing prescription drugs shall impose prescription tracking controls consistent with those endorsed by the New York state board of pharmacy and recommended to the board of regents and the state department of education from time to time.
      §2.      This local law shall take effect 120 days after enactment.
