Title
Resolution authorizing the filing of applications for state assistance payments for municipal park projects, local waterfront revitalization projects, and a Hudson River Valley Greenway project within the City of New York and the signing of associated state contracts under the appropriate laws of New York State.

Whereas, The State of New York provides financial assistance for municipal park projects; and
Whereas, Articles 54 and 56 of the New York State Environmental Conservation Law ("ECL") and any rules and regulations promulgated pursuant thereto require a resolution to be adopted by the governing body of a municipality to authorize applications for such state assistance payments; and
Whereas, The State of New York also provides financial assistance for local waterfront revitalization projects; and
Whereas, ECL, Article 54 and any rules and regulations promulgated pursuant thereto require a resolution to be adopted by the governing body of a municipality to authorize applications for such state assistance payments; and
Whereas, The State of New York also provides financial assistance for Hudson River Valley Greenway projects; and
Whereas, ECL, Articles 44 and 56 and any rules and regulations promulgated pursuant thereto require a resolution to be adopted by the governing body of a municipality to authorize applications for such state assistance payments; and
Whereas, The City of New York has examined and duly considered the applicable laws of the City and State of New York and deems it to be in the public interest to file one or more than one application for such financial assistance payments; and
Whereas, The New York City Department of Parks and Recreation has prepared applications to the New York State Office of Parks, Recreation and Historic Preservation for the municipal park projects and Hudson River Valley Greenway project, entitled the 79th Street Boat Basin Public Piers and Docks project, all of which are also identified in the list attached to this Resolution and incorporated herein by this references as Attachment No. 1; and
Whereas, The New York City Department of Parks and Recreation has also prepared applications to the New York State Department of State for the local waterfront revitalization projects, which are also identified in the list attached hereto as Attachment No. 1; and
Whereas, The New York City Department of Parks and Recreation has also prepared an application to the Greenway Heritage Conservancy for the 79th Street Boat Basin Public Piers and Docks project, which is also identified in the list attached hereto as Attachment No. 1; and
Whereas, If the New York State Office of Parks, Recreation and Historic Preservation approves the applications for the municipal parks, it is necessary that a contract by and between the State of New York and the City of New York be executed in connection with such state assistance payments for each approved project application; and
Whereas, If the New York State Department of State approves the applications for the local waterfront revitalization projects, it is necessary that a contract by and between the State of New York and the City of New York be executed in connection with such state assistance payments for each approved project application; and
Whereas, If the New York State Office of Parks, Recreation and Historic Preservation or the Greenway Heritage Conservancy approves the application for the 79th Street Boat Basin Public Piers and Docks project, it is necessary that a contract by and between the State of New York and the City of New York be executed in connection with such state assistance payments for the approved project application; and
Whereas, The New York City Department of Parks and Recreation is the agency charged with the management and physical improvement of all designated parkland owned by the City of New York; now therefore, be it
Resolved by the Council of the City of New York that:
1. The filing of an application for such sate assistance payments for the projects specified in Attachment No. 1 in the form required by the State of New York, in conformity with the applicable laws of the State of New York, including all understandings and assurances required by said applications, is hereby authorized;
2. Henry J. Stern, as Commissioner of the New York City Department of Parks and Recreation, or his successor(s), is hereby authorized and directed as the official representative of the City of New York to submit an application for funds to the New York State Office of Parks, Recreation and Historic Preservation in accordance with the provisions of Title 3 of the Clean Water/Clean Air Bond Act of 1996 (Title 3 of ECL, Article 56) and Title 9 of the Environmental Protection Act (Title 9 of ECL, Article 54) for the municipal park projects, in an amount not to exceed the amounts specified therein; to act in connection with such applications for grants of state assistance payments, including the provision of such additional information as may be required; and upon approval of said application by New York State for such projects, to enter into and execute project agreements for state assistance contracts with the State for such financial assistance to the New York City Department of Parks and Recreation for each said approved application;
3. Henry J. Stern, as Commissioner of the New York City Department of Parks and Recreation, or his successor(s), is hereby authorized and directed as the official representative of the City of New York to submit an application for funds to the New York State Department of State in accordance with the provisions of Title 11 of the Environmental Protection Act (Title 11 of ECL, Article 54) for the local waterfront revitalization projects, in an amount not to exceed the amounts specified therein; to act in connection with such applications for grants of state assistance payments, including the provision of such additional information as may be required; and upon approval of said application by New York State for such projects, to enter into and execute project agreements for state assistance contracts with the State for such financial assistance to the New York City Department of Parks and Recreation for each said approved application;
4. Henry J. Stern, as Commissioner of the New York City Department of Parks and Recreation, or his successor(s), is hereby authorized and directed as the official representative of the City of New York to submit an application for funds to the New York State Office of Parks, Recreation and Historic Preservation and to the New York Greenway Heritage Conservancy in accordance with the provisions of Title 3 of the Clean Water/Clean Air Bond Act of 1996 (Title 3 of ECL, Article 56), "Hudson River Valley Greenway," and the Hudson River Valley Greenway Act (ECL, Article 44) for the 79th Street Boat Basin Public Piers and Docks project, in an amount not to exceed the amounts specified therein; to act in connection with such application for a grant of state assistance payments, including the provision of such additional information as may be required; and upon approval of said application by New York State for such project, to enter into and execute a project agreement for state assistance contract with the State for such financial assistance to the New York City Department of Parks and Recreation for each said approved application;
5. Fifteen certified copies of this resolution shall be prepared for forwarding to the New York State Department of Parks and Recreation, the New York Sate Department of State, and the Greenway Heritage Conservancy.
