Summary: This bill would require the Commissioner of Parks and Recreation (Commissioner) to inspect each public drinking fountain to evaluate its condition and functionality and test the water from the fountain at least twice per year, and to maintain an online drinking fountains map that would include for each drinking fountain: (i) the location; (ii) the date the fountain was most recently inspected; (iii) the condition of the fountain, including whether it is functional or out of service; (iv) whether the fountain is routinely shut off during certain seasons, and if so, the dates during which it is shut off; (v) the date the water from the fountain was most recently tested; and (vi) the results of the most recent test of the water. The Commissioner would be required to post and update signage at each drinking fountain stating whether the water is safe to drink, the date the water from the fountain was most recently tested, and a QR code containing a link to access the online map.

A Local Law to amend the administrative code of the city of New York, in relation to requiring inspection and testing of public drinking fountains and establishing an online map of public drinking fountains

 

Be it enacted by the Council as follows:

 

Section 1. Chapter 1 of title 18 of the administrative code of the city of New York is amended by adding a new section 18-171 to read as follows:

§ 18-171 Testing of public drinking fountains. a. Definitions. As used in this section, the term “public drinking fountain” means a plumbing fixture maintained by an agency and made available for use by the public that allows a user to obtain a drink directly from a stream of flowing potable water without the use of any accessories.

b. Water testing. No less than twice per year, the commissioner shall (i) inspect each public drinking fountain to evaluate its condition and functionality and (ii) test the water of each public drinking fountain to determine whether it is safe for human consumption.

c. Online map. The commissioner shall maintain an online map of public drinking fountains. Such map shall include, but need not be limited to, the following information for each public drinking fountain:

1. The location;

2. The date that the public drinking fountain was most recently inspected;

3. The condition of the public drinking fountain, including whether it is functional or out of service;

4. Whether the public drinking fountain is routinely shut off during certain seasons, and, if so, the dates during which the public drinking fountain is shut off;

5. The date that the water from the public drinking fountain was most recently tested; and

6. The results from the most recent test of the water from the public drinking fountain, including whether it is safe to consume.

d. Signage. The commissioner shall post and update signage on or adjacent to each public drinking fountain that includes the following:

1. Whether the water from the public drinking fountain is safe to consume;

2. The date that the water from the public drinking fountain was most recently tested; and

3. A QR code containing a link to access the online map required by subdivision c of this section.

§ 3. This local law takes effect 60 days after it becomes law.
