Summary: This bill would require the Office of Long-Term Planning and Sustainability (OLTPS), in consultation with the Department of Environmental Protection, the Department of Transportation, the Department of Health and Mental Hygiene, and the New York City Economic Development Corporation, to conduct a recurring study, the first of which would be due on December 1 2027, with all others due every 5 years thereafter, assessing the environmental and health impacts of the John F. Kennedy International Airport (JFK) on communities in Southeast Queens. The bill would require OLTPS to consult with environmental justice organizations when conducting such study. Finally, the bill would require OLTPS and other relevant agencies to recommend and implement city programs to mitigate any adverse environmental and health effects found in such study, and recommend to the mayor any amendments to the city’s JFK lease agreement based on the study.

A Local Law to amend the administrative code of the city of New York, in relation to requiring the office of long-term planning and sustainability to conduct environmental impact studies of John F. Kennedy international airport and to implement responsive environmental mitigation programs, and the repeal of such amendment upon the expiration thereof

 

Be it enacted by the Council as follows:

 

Section 1. Subchapter 2 of chapter 1 of title 3 of the administrative code of the city of New York is amended by adding a new section 3-133 to read as follows:

§ 3-133 Environmental impacts of John F. Kennedy international airport on southeast Queens. a. Definitions. As used in this section, the following terms have the following meanings:

Airport traffic. The term “airport traffic” means air traffic, aircraft ground traffic, and vehicular traffic within, or coming in or out of, John F. Kennedy international airport.

Office. The term “office” means the office of long-term planning and sustainability, as established by subdivision a of section 20 of the New York city charter.

Relevant agency. The term “relevant agency” means, as applicable, the department of environmental protection, the department of transportation, the department of health and mental hygiene, the New York city economic development corporation, or any other agency the mayor deems relevant.

Study area. The term “study area” means Queens community districts 10, 12, 13, and 14.

b. The office, in consultation with the relevant agencies, shall conduct a recurring study assessing the environmental impacts of airport traffic on communities within the study area. No later than December 1, 2027, the office shall publish on the office’s website and submit to the mayor and the speaker of the council a report with the findings of such study. No later than December 1 of every fifth year thereafter, the office shall publish an updated version of the report on the office’s website, and submit such updated report to the mayor and the speaker of the council.

c. Each report required by subdivision b of this section shall include, but need not be limited to:

1. A collection and analysis of air quality data, including an assessment of the correlation between air quality and airport traffic;

2. A collection and analysis of noise pollution data, including an assessment of the correlation between noise pollution and airport traffic;

3. An evaluation of any programs or projects within John F. Kennedy international airport or within the study area meant to reduce or mitigate the environmental impacts of airport traffic, conducted by an agency, the port authority of New York and New Jersey, or any private organizations; 

4. An analysis of the public health impacts of such air and noise pollution on the communities within the study area;

5. Recommendations for expanding or amending any existing city programs, or establishing new city programs, to mitigate air pollution, noise pollution, and any resulting negative public health impacts found in such study; and

6. For all reports published subsequent to the first report, updates on any such recommendations that have been implemented by the relevant agencies.

d. In conducting the recurring study required by subdivision b of this section, the office shall consult environmental justice organizations serving communities in the study area.

e. The office, or any relevant agency in coordination with the office, shall implement the recommendations published pursuant to paragraph 5 of subdivision c of this section.

f. Within 30 days of the publication of each report required by subdivision b of this section, the office shall submit to the mayor any recommended amendments to the agreement of lease of the municipal air terminals between the city and the port authority of New York and New Jersey that would mitigate air pollution, noise pollution, and any resulting negative public health impacts reported in such study.

§ 2. This local law takes effect immediately and expires and is deemed repealed on December 31, 2060.
