A Local Law to amend the administrative code of the city of New York, in relation to parking permits for funeral directors
Be it enacted by the Council as follows:
Section 1. Subchapter 2 of chapter 1 of title 19 of the administrative code of the city of New York, is amended by adding a new section 19-162.6 to read as follows:
§ 19-162.6 Parking permits for funeral directors. a. Definitions. For purposes of this section, the following terms have the following meanings:
Authorized funeral vehicle. The term “authorized funeral vehicle” means a hearse or other motor vehicle which is used for the purpose of carrying the body of a deceased person.
Funeral directing. The term “funeral directing” means the care and disposal of the body of a deceased person, including but not limited to the preservation, disinfection, and preparation by embalming or otherwise, of the body of a deceased person for funeral services, transportation, burial or cremation, as well as funeral directing or embalming, as those terms are defined in article 34 of the public health law.
Funeral director. The term “funeral director” means a person possessing a valid license issued pursuant to article 34 of the public health law.
Funeral establishment. The term “funeral establishment” means a place principally used for the care and preparation of a body of a deceased person for disposition and for mourning or funeral ceremonial purposes.
Funeral firm. The term “funeral firm” means an individual, partnership, corporation or estate representative engaged in the business and practice of funeral directing.
b. The department shall maintain a process through which a funeral firm may apply for a parking permit.
c. Notwithstanding any local law or rule to the contrary, it shall be permissible for a funeral director to park an authorized funeral vehicle which is owned, registered or leased by such funeral director or by the funeral firm that operates the funeral establishment where such funeral director serves as a funeral director, and which displays a parking permit issued pursuant to this section, on the roadway adjacent to such funeral establishment, in an area where parking is prohibited by a posted sign. It shall not be permissible for a funeral director to park where parking is prohibited by rule or where stopping or standing are prohibited by a posted sign or rule.
d. Each funeral firm applying for a parking permit issued pursuant to this section shall file an application in such form and detail as the department may prescribe. Such application shall be submitted on behalf of a funeral director by the funeral firm that operates the funeral establishment where such funeral director serves as a funeral director. Such application shall include the license plate number of the authorized funeral vehicle or authorized funeral vehicles, and the name and registration number of the funeral director or funeral directors, to be associated with such permit.
e. Only one parking permit may be issued by the department to any funeral firm, and such shall include on the front side thereof the license plate numbers of any authorized funeral vehicles, and the name and registration number of the funeral director or funeral directors, to be associated with such parking permit. When determining the number of authorized funeral vehicles to include on each such parking permit, the department shall consider the availability of and need for parking of authorized funeral vehicles on the roadway adjacent to the funeral establishment, the potential impact on the surrounding area, and any other factors the department deems appropriate.
f. A parking permit issued pursuant to this section shall be valid for a year, unless revoked. A funeral firm shall be permitted to apply for a renewal of such permit at least sixty days prior to the expiration of such parking permit.
g. Any misuse of a parking permit, as determined by the department, issued pursuant to this section shall be sufficient cause for revocation of such permit.
§ 2. This local law takes effect immediately.
