A Local Law to amend the administrative code of the city of New York, in relation to the establishment of municipal grocery stores

 

Be it enacted by the Council as follows:

 

Section 1. Title 22 of the administrative code of the city of New York is amended by adding a new chapter 15 to read as follows:

CHAPTER 15

MUNICIPAL GROCERY STORES

§ 22-1501 Definitions. As used in this chapter, the following terms have the following meanings:

Agency head. The term “agency head” means the commissioner of small business services or the head of another agency designated by the mayor.

Contracted entity. The term “contracted entity” has the same meaning as set forth in section 22-821.

Standard union compensation. The term “standard union compensation” means wages and benefits that are comparable to the wages and benefits that are provided to workers in the same trade or occupation in the city who are covered by a collective bargaining agreement.

§ 22-1502 Establishment of municipal grocery stores. No later than 2 years after the effective date of the local law that added this section, the agency head, in consultation or partnership to the extent feasible with a contracted entity, shall establish at least 5 grocery stores in each borough. The agency head shall make best efforts to ensure that at least half of such grocery stores are established in underserved areas where access to affordable and nutritious food is limited.

§ 22-1503 Operational requirements. The grocery stores established by the agency head under section 22-1502 shall remain open for business at least 12 hours per day, 5 days per week and shall offer affordable and nutritious food, including a range of fresh produce, for sale. The agency head shall provide employees of the grocery stores no less than standard union compensation.

§ 2. This local law takes effect immediately.
