Title: A Local Law to amend the administrative code of the city of New York, in relation to safety reports and plans required of third-party food delivery services

Summary: This bill would require third-party food delivery services licensed by the Department of Consumer and Worker Protection to submit an annual safety report to the Department. The safety report would be required to include information regarding safety incidents involving food delivery workers, including those that result in death or serious injury. The bill would also require third-party food delivery services to submit a safety plan with any initial or renewal license application. The safety plan would be required to include information regarding the services’ policies and procedures related to monitoring and responding to safety incidents, taking any disciplinary action against food delivery workers, and training food delivery workers and delivery service personnel.

A Local Law to amend the administrative code of the city of New York, in relation to safety reports and plans required of third-party food delivery services

 

Be it enacted by the Council as follows:

 

Section 1. Section 20-563 of the administrative code of the city of New York is amended by adding new definitions of “delivery device,” “delivery vehicle,” “personal information,” “powered bicycle,” “powered mobility device,” “safety incident,” and “trip” in alphabetical order to read as follows:

Delivery device. The term “delivery device” means any powered mobility device, powered bicycle, bicycle, moped, motorcycle, or other mode of personal transportation used by a food delivery worker to perform a food delivery, provided that the term does not include public transportation.

Delivery vehicle. The term “delivery vehicle” means any motor vehicle used by a food delivery worker to perform a food delivery, provided that the term does not include public transportation.

Personal information. The term “personal information” means any information concerning a natural person which, because of name, number, personal mark, or other identifier, can be used to identify such natural person.

Powered bicycle. The term “powered bicycle” has the same meaning as set forth in section 20-609.

Powered mobility device. The term “powered mobility device” has the same meaning as set forth in section 20-609. 

Safety incident. The term “safety incident” means an event involving a food delivery worker performing services pursuant to a contract with a third-party food delivery service licensed under this subchapter, that occurred during the course of a delivery performed by such food delivery worker or during such food delivery worker’s scheduled rest or break period recognized by the third-party food delivery service and that resulted in death or serious injury.

Trip. The term “trip” means the time spent, distance travelled, and route followed by a food delivery worker to deliver food, including, but not limited to, travel to 1 or more pick-up locations; selecting, preparing, assembling, waiting for, and picking up the food for delivery; and travel to and unloading and depositing such food at 1 or more drop-off locations, including any time spent waiting for goods to be retrieved by a customer or other person, provided that the term “trip” shall not include any time spent, distance travelled, or route followed for the delivery of food using a vehicle that is required by federal or state law, rule, or regulation to be registered with the federal motor carrier safety administration.

                     § 2. Subdivision b of section 20-563.1 of the administrative code of the city of New York is amended by adding a new paragraph 5 to read as follows:

5. A safety plan, which shall describe in detail the third-party food delivery service’s policies and procedures related, but not limited to, the following:

(a) Monitoring safety incidents, including the use of any technologies, tools, or automated systems for tracking deliveries performed by a food delivery worker and any guidance provided to employees of such third-party food delivery service for review of such technologies, tools, or automated systems;

(b) Responding to safety incidents, including procedures for communicating with food delivery workers, pedestrians, motorists, or other third parties involved in such safety incidents, and for coordinating with the police department and other agencies in connection with such safety incidents;

(c) Classifying safety incidents, including whether and how third-party vendors or platforms, if any, contribute to the creation of such classifications;

(d) Categorizing delivery devices and delivery vehicles, including whether and how third-party vendors or platforms, if any, contribute to the creation of such categories;

(e) Taking disciplinary action against food delivery workers as a result of safety incidents;

(f) Setting, assigning, establishing, and adjusting delivery time estimates and trips for food delivery workers, including the use of any algorithmic or incentive-based mechanisms or technologies on a third-party food delivery platform;

(g) Analyzing safety incidents to assess the safety of trips, including identifying the locations, if any, where such safety incidents reoccur;

(h) Engaging with food delivery workers to develop policies and procedures related to occupational and street safety;

(i) Providing training and education to food delivery workers related to occupational and street safety; and

(j) Providing training and education to employees of such third-party food delivery service responsible for handling or responding to safety incidents, including customer service personnel and management.

§ 3. Subchapter 36 of chapter 2 of title 20 of the administrative code of the city of New York is amended by adding a new section 20-563.14 to read as follows:

§ 20-563.14 Safety report. a. Every third-party food delivery service licensed under this subchapter shall, no later than February 1 of each year, submit to the department a safety report covering all safety incidents that occurred during the immediately preceding calendar year. Such report shall include the total number of safety incidents that occurred during the immediately preceding calendar year, disaggregated by incident type. The third-party food delivery service shall exclude the personal information of any food delivery worker or any other person involved in a safety incident from such report.

b. Such report shall also include, for each safety incident:

1. The date, time, borough, and global positioning system data providing the location where the safety incident occurred;

2. The type of delivery device or delivery vehicle involved;

3. A general description of the safety incident;

4. Whether the incident occurred during the course of a delivery or during a scheduled rest or break period recognized by the third-party food delivery service; and

5. What disciplinary action, if any, was taken by the third-party food delivery service against the food delivery worker involved in the safety incident.

§ 4. This local law takes effect 120 days after it becomes law.
