A Local Law to amend the administrative code of the city of New York, in relation to requiring the police department to provide information and officer training relating to identity theft
Be it enacted by the Council as follows:
Section 1. Title 14 of the administrative code of the city of New York is amended by adding a new section 14-198 to read as follows:
§ 14-198 Public information and officer training regarding identity theft.
a. The department shall post on its website information about identity theft, including information about reporting suspected identity theft to the department. Such information shall include, but need not be limited to:
1. A description of the types of conduct that constitute identity theft, methods perpetrators of identity theft use to steal personal information, and potential uses of personal information that has been stolen;
2. Guidance on protecting personal information; and
3. Information about how to report suspected identity theft to the department, including, but not limited to, the process of the department for receiving and investigating complaints of suspected identity theft, where such complaints may be filed in accordance with section 646 of the executive law, and any supporting documentation, such as financial documents or other documents or records that may demonstrate identity theft, that a victim of suspected identity theft may possess.
b. The department shall provide training on responding to and investigating reports of suspected identity theft to:
1. Any department recruit, as part of such recruit’s academy training; and
2. Any uniformed member of the department who did not receive such training as part of such member’s academy training.
c. The training required pursuant to subdivision b shall include, but need not be limited to, instruction on:
1. The types of illegal conduct that constitute identity theft;
2. The types of documentation and other proof that may be used to support a criminal complaint alleging identity theft; and
3. Department policies on responding to and investigating such complaints.
§ 2. This local law takes effect April 1, 2026.
