RESOLUTION NO. 2216
Resolution approving the decision of the City Planning Commission on ULURP No. C 090445 ZSK (L.U. No. 1215), for the grant of a special permit pursuant to Section 78-312(d) of the Zoning Resolution of the City of New York to modify the height and setback requirements of Section 23-632 (Front Setbacks in districts where front yards are not required) to facilitate the construction of a mixed-use development on property located at 136-50 Flushing Avenue (Block 2033, Lot 1), in an R8/C2-4 District, within a Large-Scale Residential Development, Borough of Brooklyn.

WHEREAS, the City Planning Commission filed with the Council on September 1, 2009 its decision dated August 19, 2009 (the "Decision"), on the application submitted by the New York City Department of Housing Preservation and Development, pursuant to Sections 197-c and 201 of the New York City Charter, for the grant of a special permit pursuant to Section 78-312(d) of the Zoning Resolution of the City of New York to modify the height and setback requirements of Section 23-632 (Front Setbacks in districts where front yards are not required) to facilitate the construction of a mixed-use development on property located at 136-50 Flushing Avenue (Block 2033, Lot 1), in an R8/C2-4 District, within a Large-Scale Residential Development (ULURP No. C 090445 ZSK), Community District 2, Borough of Brooklyn (the "Application");
WHEREAS, the Application is related to ULURP Applications Numbers C 090444 ZMK (L.U. No. 1214), a zoning map amendment changing an M1-2 district to an R8/C2-4 district; and C 090446 HAK (L.U. No. 1216), an urban development action area project designation, project approval and disposition of city-owned property;
WHEREAS, the Decision is subject to review and action by the Council pursuant to Section 197-d(b)(3) of the City Charter;
WHEREAS, the City Planning Commission has made the findings required pursuant to Section 78-313 of the Zoning Resolution of the City of New York;
WHEREAS, upon due notice, the Council held a public hearing on the Decision and Application on September 22, 2009;
WHEREAS, the Council has considered the land use implications and other policy issues relating to the Decision and Application; and
WHEREAS, the Council has considered the relevant environmental issues and the Negative Declaration, issued on May 20, 2009 (CEQR No. 09HPD030K);
RESOLVED:
The Council finds that the action described herein will have no significant effect on the environment.
Pursuant to Sections 197-d and 200 of the City Charter and on the basis of the Decision and Application, and based on the environmental determination and consideration described in this report, C 090445 ZSK, incorporated by reference herein, the Council approves the Decision.
