Resolution authorizing the filing of applications for state assistance payments for Municipal Park projects, Local Waterfront Revitalization Projects, and Hudson River Estuary projects within the City of New York and the signing of associated state contracts under the appropriate laws of New York State.

Whereas, the State of New York provides financial assistance for municipal park projects; and
Whereas, Article 54 of the New York State Environmental Conservation Law ("ECL") and any rules and regulations promulgated pursuant thereto require a resolution to be adopted by the governing body of a municipality to authorize applications for such state assistance payments; and
Whereas, the State of New York also provides financial assistance for local waterfront revitalization projects; and
Whereas, ECL Article 54 and any rules and regulations promulgated pursuant thereto require a resolution to be adopted by the governing body of a municipality to authorize applications for such state assistance payments; and
Whereas, the State of New York also provides financial assistance for projects to implement the Hudson River Estuary Plan, developed pursuant to and in accordance with the Hudson River Estuary Management Act (ECL ยง 11-0306); and
Whereas, the New York State Department of Environmental Conservation requires that a resolution be adopted by the governing body of a municipality to authorize applications for such state assistance payments; and
Whereas, the City of New York has examined and duly considered the applicable laws of the City and State of New York and deems it to be in the public interest to file one or more than one application for such financial assistance payments; and
Whereas, the City of New York Department of Parks & Recreation (the "City Department of Parks") has prepared applications to the New York State Office of Parks, Recreation and Historic Preservation for municipal park projects, which are identified in the list attached to this Resolution and incorporated herein by this reference as Attachment No. 1; and
Whereas, the City Department of Parks has also prepared applications to the New York State Department of State for local waterfront revitalization projects, which are also identified in the list attached hereto as Attachment No. 1; and
Whereas, the City Department of Parks has also prepared applications to the New York State Department of Environmental Conservation for Hudson River Estuary Action Plan projects, which are also identified in the list attached hereto as Attachment No. 1; and
Whereas, if the New York State Office of Parks, Recreation and Historic Preservation approves the applications for the municipal park projects, it is necessary that a contract by and between the State of New York and the City of New York be executed in connection with such state assistance payments for each approved project application; and
Whereas, if the New York State Department of State approves the applications for the local waterfront revitalization projects, it is necessary that a contract by and between the State of New York and the City of New York be executed in connection with such state assistance payments for each approved project application; and
Whereas, if the New York State Department of Environmental Conservation approves the applications for the Hudson River Estuary Action Plan projects, it is necessary that a contract by and between the State of New York and the City of New York be executed in connection with such state assistance payments for each approved project application; and
Whereas, the City Department of Parks is the agency charged with the management and physical improvement of all designated parkland owned by the City of New York; now therefore, be it
Resolved by the Council of the City of New York that:
1. The filing of an application for such state assistance payments for the projects specified in Attachment No. 1 in the form required by the State of New York, in conformity with the applicable laws of the State of New York, including all understandings and assurances required by said applications, is hereby authorized;
2.Adrian Benepe, as Commissioner of the City Department of Parks, or his successor(s), is hereby authorized and directed as the official representative of the City of New York to submit an application for funds to the New York State Office of Parks, Recreation and Historic Preservation in accordance with the provisions of Article 54, Title 9 of the Environmental Conservation Law for each of the municipal park projects, in an amount not to exceed the amounts specified in each application; to act in connection with each such application for grants of state assistance payments, including the provision of such additional information as may be required; and upon approval of each said application by New York State for such projects, to enter into and execute a project agreement with the State for such financial assistance to the City Department of Parks for each said approved application, to submit documentation for each approved project, to undertake the approved projects, and to otherwise act for the City of New York in all matters related to the approved projects and to any State assistance for such projects;
3.Adrian Benepe, as Commissioner of the City Department of Parks, or his successor(s), is hereby authorized and directed as the official representative of the City of New York to submit an application for funds to the New York State Department of State in accordance with the provisions of Article 54, Title 11 of the Environmental Conservation Law for each of the local waterfront revitalization projects, in an amount not to exceed the amounts specified in each application; to act in connection with each such application for grants of state assistance payments, including the provision of such additional information as may be required; and upon approval of each said application by New York State for such projects, to enter into and execute a project agreement with the State for such financial assistance to the City Department of Parks for each said approved application, to submit documentation for each approved project, to undertake the approved projects, and to otherwise act for the City of New York in all matters related to the approved projects and to any State assistance for such projects;
4.Adrian Benepe, as Commissioner of the City Department of Parks, or his successor(s), is hereby authorized and directed as the official representative of the City of New York to submit an application for funds to the New York State Department of Environmental Conservation in accordance with the provisions of Section 11-0306 of the Environmental Conservation Law for each of the Hudson River Estuary Action Plan projects, in an amount not to exceed the amounts specified in each application; to act in connection with each such application for grants of state assistance payments, including the provision of such additional information as may be required; and upon approval of each said application by New York State for such projects, to enter into and execute a project agreement with the State for such financial assistance to the City Department of Parks for each said approved application, to submit documentation for each approved project, to undertake the approved projects, and to otherwise act for the City of New York in all matters related to the approved projects and to any State assistance for such projects;
5. Twenty-five (25) certified copies of this Resolution shall be prepared for forwarding to the New York State Office of Parks, Recreation and Historic Preservation, the New York State Department of State, and the New York State Department of Environmental Conservation.
