Summary: This bill would require the Department of Health and Mental Hygiene (DOHMH) to create resources related to the unique health care needs of LGBTQI+ individuals that may be relevant to such individuals, their families, or health care providers. Such resources would include information regarding access to LGBTQI+ health services and obtaining and providing gender-affirming care. DOHMH would be required to post the materials on its website in English and in the designated citywide languages and update the materials as necessary to ensure the accuracy of information. The bill would also require DOHMH to maintain a publicly accessible map of LGBTQI+ health services searchable by services offered. The map would include address, office hours, contact information, available health services, and payment information, including types of insurance accepted, for each provider listed. Finally, the bill would make purely technical changes to renumber two preceding sections of the Administrative Code.

A Local Law to amend the administrative code of the city of New York, in relation to requiring the department of mental health and hygiene to create and make available on their website LGBTQI+ health and gender-affirming care resources and a searchable map of LGBTQI+ health services

 

Be it enacted by the Council as follows:

 

Section 1. Section 17-199.30 of the administrative code of the city of New York, as added by local law number 172 for the year 2025, is redesignated section 17-199.31.

§ 2. Section 17-199.31 of the administrative code of the city of New York, as added by local law number 75 for the year 2026, is redesignated section 17-199.32.

§ 3. Chapter 1 of title 17 of the administrative code of the city of New York is amended by adding a new section 17-199.33 to read as follows:

§ 17-199.33 LGBTQI+ health and gender-affirming care resources. a. Definitions. For purposes of this section, the following terms have the following meanings:

Designated citywide languages. The term “designated citywide languages” has the same meaning as set forth in section 23-1101.

Gender-affirming care. The term “gender-affirming care” means medical, surgical, behavioral health, psychosocial, and other services intended to support and affirm a person’s self-determined gender identity or expression.

LGBTQI+. The term “LGBTQI+” means lesbian, gay, bisexual, transgender, queer, questioning, intersex, gender non-conforming, or non-binary.

b. The commissioner shall create resources related to the unique health care needs of LGBTQI+ individuals that may be relevant to such individuals, their families, or health care providers. The commissioner shall make such resources available on the department’s website in English and in the designated citywide languages and shall update such resources as necessary to ensure the accuracy of information. Such resources shall include information regarding:

1. Access to LGBTQI+ health services, including LGBTQI+-affirming providers;

2. Obtaining gender-affirming care, including related rights and protections;

3. Providing gender-affirming care, including correct pronoun usage; and

4. Any other information related to health care or services that the commissioner deems relevant to LGBTQI+ individuals, their families, or health care providers.

§ 4. Chapter 1 of title 17 of the administrative code of the city of New York is amended by adding a new section 17-199.34 to read as follows:

§ 17-199.34 Map of LGBTQI+ health services. a. Definitions. For purposes of this section, the following terms have the following meanings:

Gender-affirming care. The term “gender-affirming care” means medical, surgical, behavioral health, psychosocial, and other services intended to support and affirm a person’s self-determined gender identity or expression.

LGBTQI+. The term “LGBTQI+” means lesbian, gay, bisexual, transgender, queer, questioning, intersex, gender non-conforming, or non-binary.

b. The commissioner shall maintain on the department’s website a publicly accessible, interactive map of LGBTQI+ health services in the city.

c. The map maintained pursuant to subdivision b shall be searchable by services offered, which shall include, but need not be limited to:

1. Counseling;

2. Gender-affirming care;

3. Primary care; and

4. Sexual health services.

d. The map maintained pursuant to subdivision b shall provide the following information for each provider included on such map, to the extent such information is available to the commissioner:

1. Address, office hours, and contact information;

2. Available health services; and

3. Payment information, including types of insurance accepted.

§ 5. This local law takes effect immediately.
