A Local Law to amend the administrative code of the city of New York, in relation to enforcing violations against unlicensed commuter vans
Be it enacted by the Council as follows:
Section 1. Chapter 5 of title 19 of the administrative code of the city of New York is amended by adding a new section 19-504.5 to read as follows:
§ 19-504.5 Enforcement against unlicensed commuter vans and unauthorized commuter van services. a. The commission shall, in collaboration with the police department and the department of transportation, develop and maintain a checklist of state and local laws, rules and regulations which apply to the operation of an unlicensed commuter van or concern the safety and well-being of bystanders or such van’s occupants. This checklist shall include any applicable laws, rules and regulations concerning the licensure of the vehicle, the authorization of the commuter van service, the licensure of the driver, and any applicable insurance or inspection requirements.
b. Any officer authorized to enforce the commission’s rules and regulations governing commuter vans shall, upon stopping and identifying a vehicle as an unlicensed commuter van, examine the checklist developed pursuant to subdivision a of this section and determine which, if any, such laws, rules and regulations have been violated, and any notice of violation issued shall be for the maximum monetary penalty permitted by law for each such violation.
§ 2. This local law takes effect 120 days after it becomes law.
