Summary: This bill would require the Commissioner of Small Business Services to include in the next contract the Department of Small Business Services (SBS) executes with the Economic Development Corporation (EDC) requirements that EDC study and develop recommendations regarding the effects tourism has on the quality of life in DUMBO. This bill would also require the Commissioner to include in the contract a requirement that EDC, within 6 months of contract execution, submit a report summarizing the study and recommendations to the Mayor, the Speaker of the Council, the Brooklyn Borough President, and each Council Member with jurisdiction over DUMBO and publish the report online.

A Local Law in relation to requiring a study and report on the effects of tourism on DUMBO

 

Be it enacted by the Council as follows:

 

Section 1. a. Definitions. As used in this local law, the following terms have the following meanings:

Brooklyn navy yard development entity. The term “Brooklyn navy yard development entity” has the same meaning as set forth in section 22-821 of the administrative code of the city of New York.

City. The term “city” means the city of New York.

Contracted entity. The term “contracted entity” means a local development corporation or other not-for-profit corporation, a majority of whose members are appointed by the mayor, that contracts with the city to provide or administer economic development benefits on behalf of the city and expending city capital appropriations in connection therewith, except that such term does not include the Brooklyn navy yard development entity

Covered contract. The term “covered contract” means any contract under which a contracted entity is engaged in providing or administering economic development benefits on behalf of the city.

DUMBO. The term “DUMBO” means the area bounded on the south by Prospect Street from Old Fulton Street to Bridge Street, bounded on the east by Bridge Street from Prospect Street to the East River, bounded on the north by the East River from Bridge Street to Old Fulton Street, and bounded on the west by Old Fulton Street from the East River to Prospect Street.

b. DUMBO tourism study. 1. In the first covered contract executed on or after the effective date of this local law, the commissioner of small business services shall require that the contracted entity conduct a study on the effects of tourism on DUMBO. Through such study, the contracted entity shall collect information regarding the effects of tourism on DUMBO in the following areas:

(a) Sanitation;

(b) Public safety;

(c) Environmental quality;

(d) Vending;

(e) Pedestrian flow and mobility;

(f) Economic development;

(g) Transportation; and

(h) Any other area deemed relevant by the contracted entity.

2. Through such study, the contract entity shall also develop recommendations to address the effects of tourism on DUMBO in the areas set forth in subparagraphs (a) through (h) of paragraph 1 of this subdivision, with a focus on strategies to coordinate interagency enforcement to address such effects.

c. Report. In the first covered contract executed on or after the effective date of this local law, the commissioner of small business services shall require that, no later than 6 months after the execution of such contract, the contracted entity submit to the mayor, the speaker of the council, the Brooklyn borough president, and each council member for any council district that includes DUMBO, and post on the contracted entity’s website, a report on the effects of tourism on DUMBO. Such report shall include the information gathered and recommendations developed through the study required under subdivision b of this section.

§ 2. This local law takes effect immediately.
