Resolution approving the authorization of the City Planning Commission pursuant to Section 62-722 (b) of the Zoning Resolution to authorize the modification of the requirements of Section 62-632 to waive the minimum required 50% planting area within the pedestrian circulation zone in connection with two mixed used building (Non-ULURP No. N 010617 ZAK; L.U. No. 1278).

WHEREAS, the City Planning Commission filed with the Council on October 31, 2001 its decision dated October 24, 2001 (the "Authorization"), on the application submitted by the Department of Housing Preservation and Development, pursuant to Section 62-722(b) of the New York City Zoning Resolution for the grant of an authorization to allow modification of the requirements of Section 62-632 (to waive the minimum required 50% planting area within the pedestrian circulation zone in connection with a proposed 15-story and a 25-story mixed use development on property located at 460 Kent Avenue (Block 2134/Lot 36), in R7-3 and R7-3/C2-4 Districts, Community District 1, Borough of Brooklyn (Non-ULURP No. N 010617 ZAK) (the "Application");
WHEREAS, the Application is related to Applications Number C 010615 ZMK (L.U. No. 1125), an amendment of the Zoning Map, C 010616 ZSK (L.U. No. 1126), a special permit, and C 010619 HAK (L.U. No. 1127), UDAAP designation, project approval and disposition of city-owned property;
WHEREAS, the Authorization is subject to review and action by the Council pursuant to Section 62-722 of the Zoning Resolution;
WHEREAS, upon due notice, the Council held a public hearing on December 3, 2001 on the Authorization and Application;

WHEREAS, the Council has considered the relevant environmental issues and the Negative Declaration, issued on May 4, 2001 (CEQR No. 01HPD011K); and
WHEREAS, the Council has considered the land use implications and other policy issues relating to the Authorization and Application;
RESOLVED:
The Council finds that the action described herein will have no significant effect on the environment; and
Pursuant to Section 62-722 of the New York City Zoning Resolution and on the basis of the Authorization and Application, the Council approves the Authorization.
