Resolution calling on the New York City Department of Education to consider entering into lease agreements to furnish public schools with technology equipment once the initial term of its contract with Dell expires.

Whereas, In October of 2003, the New York City Department of Education (“DOE”) entered into an exclusive contract with Dell Marketing, L.P. (the “Dell contract”) for the sum of $85 million per contract year to provide the DOE with (among other things) computer desktop related equipment, inventory and catalogue services pertaining to existing and newly acquired computer desktop related equipment, and the management, ongoing maintenance and warranty support of such inventory; and

Whereas, The Dell contract commenced on October 1st, 2003, and will continue in effect until January 31st, 2008; and

Whereas, Thereafter, the Dell contract provides that the contract will be automatically renewed for two successive periods of one year each unless the DOE notifies Dell at least 180 days prior to the expiration of the initial term that it wishes to terminate the contract; and

Whereas, As an exclusive contract, the Dell contract prohibits the DOE from acquiring technology equipment that is within the scope of the contract from another provider, whether through a lease agreement or a lump-sum purchase agreement; and

Whereas, Pursuant to section 3602(26) of the State Education Law and regulation 175.25 of the Commissioner of the State Education Department, school districts are eligible for aid for the purchase or lease of computer equipment or terminals for instructional purposes, including mini-computers, micro-computers, peripheral devices (including printers, video display plotters and desk storage units), telecommunications hardware (including modems), special hardware boards, cables, audio, video, touch-sensitive and other electronic to human machine interface hardware and other such hardware that may be required for the operation of a computer-based instructional program; and

Whereas, There are numerous benefits to leasing technology equipment, particularly for school districts that operate in an environment of scarce resources; and

Whereas, Because less expenditure is required in a given fiscal year when technology equipment is leased as opposed to purchased in a lump sum, leasing allows school districts to “free-up” money for other needs; and

Whereas, Leasing technology equipment also allows administrators to upgrade outdated equipment and to trade-in older models for newer ones when there are advances in technology, ensuring that students have access to more up-to-date technology; and

Whereas, Because of these benefits, other large urban school districts, including those in Detroit and Chicago, have entered into lease agreements to furnish their public schools with technology equipment; now, therefore, be it

Resolved, That the Council of the City of New York calls upon the New York City Department of Education to consider entering into lease agreements to furnish public schools with technology equipment once the initial term of its contract with Dell expires.
