Summary: This bill would require each contractor that has entered into a human services contract with a city agency to disclose certain information about any subcontract to the contracting agency within 30 days of executing a subcontract with an entity known to the contractor to be a certified minority- or women-owned business enterprise for construction, professional services, standard services, or goods. Such disclosures would include the name, address, and contact information of the subcontractor and the value and type of work or goods to be provided. No later than October 31 of each year, each agency that administered a human services contract during the preceding fiscal year would be required to transmit those disclosures to the Mayor’s Office of Contract Services for each such subcontract executed or amended during that fiscal year.

A Local Law to amend the administrative code of the city of New York, in relation to reporting on minority- and women-owned business participation in subcontracts for human services contracts

Be it enacted by the Council as follows:

 

Section                      1.  Section 6-129 of the administrative code of the city of New York is amended by adding a new subdivision t to read as follows:

t. Human services subcontract reporting. 1. Each contractor that has entered into a contract for human services with an agency shall, within 30 days of executing a subcontract under such contract with an entity known to the contractor to be a certified minority- or women- owned  business enterprise for construction, professional services, standard services, or goods, submit to the contracting agency a disclosure identifying such subcontract, including: (a) the name, address, and contact information of the subcontractor; and (b) the value and type of work or goods to be provided under the subcontract.

2. Such contractor shall submit an updated disclosure no later than 30 days after any material change to such subcontract.

3. No later than October 31 of each year, each agency that administered a contract for human services during the preceding fiscal year shall transmit to the mayor’s office of contract services the disclosures received pursuant to this subdivision for each such subcontract executed or amended during such fiscal year.

§ 2.  This local law takes effect 180 days after it becomes law.
