Resolution approving the decision of the City Planning Commission on ULURP No. C 020500 PPM, modification to a previous disposition to remove the restriction limiting the use of property consisting of the former bed of Stuyvesant Street located between Astor Place and Third Avenue (Block 554/Lot 35), Manhattan (L.U. No. 163).

WHEREAS, the City Planning Commission filed with the Council on September 3, 2002 its decision dated September 3, 2002 (the "Decision") on the application submitted pursuant to Section 197-c of the New York City Charter by the Department of Citywide Administrative Services, for the removal of the restriction limiting use of property consisting of the former bed of Stuyvesant Street pursuant to zoning, located at 51 Astor Place (Block 554/Lot 35), Community District 3, Borough of Manhattan (ULURP No. C 020500 PPM) (the "Application");
WHEREAS, the Application is related to ULURP Applications Numbers C 020498 ZMM (L.U. No. 161), an amendment to the Zoning Map; C 020499 (A) ZSM (L.U. No. 162), special permits pursuant to Sections 74-743(a)(1) and 74-743(a)(2) of the Zoning Resolution; and C 020501 PPM (L.U. No. 164), modification to a previous disposition;
WHEREAS, the Decision is subject to review and action by the Council pursuant to Section 197-d(b)(3) of the City Charter;
WHEREAS, upon due notice, the Council held a public hearing on the Decision and Application on October 1, 2002;
WHEREAS, the Council has considered the relevant environmental issues and the Final Environmental Impact Statement ("FEIS") for which a Notice of Completion was issued on August 23, 2002 (CEQR No. 01DCP061M); and
WHEREAS, the Council has considered the land use implications and other policy issues relating to the Decision and Application;

RESOLVED:
Having considered the FEIS, with respect to the Application, the Council finds that:
(1) The FEIS meets the requirements of 6 N.Y.C.R.R. Part 617;
(2) From among the reasonable alternatives thereto, the actions to be approved are ones which minimize or avoid adverse environmental impacts to the maximum extent practicable; and
(3) The adverse environmental impacts revealed in the FEIS will be minimized or avoided to the maximum extent possible by incorporating as conditions to the approval those mitigative measures that were identified as practicable;
(4) The Decision and the FEIS constitute the written statement of facts, and of social, economic and other factors and standards that form the basis of this determination, pursuant to 6 N.Y.C.R.R. ยง617.9(c)(3).
Pursuant to Section 197-d of the City Charter and on the basis of the Application and the Decision the Council approves the Decision.
