Title: A Local Law to amend the administrative code of the city of New York, in relation to a decennial study on the recyclability of expanded polystyrene single service articles

Summary: This bill would require the NYC Department of Sanitation (DSNY) to decennially perform a study and report on the recyclability of expanded polystyrene (EPS) single service articles at the South Brooklyn Marine Terminal in an environmentally effective, economically feasible, and safe manner. DSNY would be required to include in such report its recommendations as to whether EPS can be so recycled, legislative actions, and the possible designation of EPS as a DSNY-managed recyclable material. The first such report would be due by January 1, 2027.

A Local Law to amend the administrative code of the city of New York, in relation to a decennial study on the recyclability of expanded polystyrene single service articles

 

Be it enacted by the Council as follows:

 

Section 1. Section 16-329 of the administrative code of the city of New York, as added by local law number 142 for the year 2013, is amended to add a new subdivision h, to read as follows:

h. No later than January 1, 2027, and no less than once every 10 years thereafter, the commissioner shall perform a study and report to the mayor and the speaker of the council regarding whether expanded polystyrene single service articles can be recycled at the designated recycling processing facility at the South Brooklyn Marine Terminal in a manner that is environmentally effective, economically feasible, and safe for employees. Such report shall include the commissioner’s recommendation as to whether expanded polystyrene single service articles could be recycled in such manner, the commissioner’s recommendation for state or local legislative action, if any, and, the commissioner’s recommendations regarding the possible designation of other expanded polystyrene products as a recyclable material for department-managed recycling, if any.

§ 2. This local law takes effect immediately.
