Summary: This bill would require the New York City Police Department, in collaboration with the Department of Transportation, to establish a program pursuant to which police officers use dynamometers to test the motor wattage and maximum assisted speed of micromobility devices for purposes of enforcing the City’s existing prohibition on certain high-power and high-speed devices. Use of such dynamometers would be limited to instances in which there is probable cause that a device operating on city streets is illegal. This bill would also require reporting of data gathered through such testing.

A Local Law to amend the administrative code of the city of New York, in relation to using micromobility dynamometers to test micromobility devices operating in the city

 

Be it enacted by the Council as follows:

 

Section 1. Chapter 1 of Title 14 of the administrative code of the city of New York is amended by adding a new section 14-199.4 to read as follows:

§ 14-199.4 Motorized micromobility device testing. a. Definitions. For purposes of this section, the following terms have the following meanings:

Micromobility device. The term “micromobility device” means a device intended for personal transportation that is not a motor vehicle, as such term is defined in section 125 of the vehicle and traffic law. The term “micromobility device” includes, but is not limited to, bicycles, electric bicycles, scooters, and electric scooters.

Micromobility dynamometer. The term “micromobility dynamometer” means an instrument capable of measuring the force, torque, or power of a motor on a micromobility device for the purpose of determining whether such device may be lawfully operated within the city under applicable state and local law.

Motorized scooter. The term “motorized scooter” has the same meaning as set forth in  section 19-176.2.

b. Testing. The police commissioner, in collaboration with the commissioner of transportation, shall establish a program to use micromobility dynamometers to determine the maximum power output and maximum assisted speed of electric motors on micromobility devices for purposes of enforcing subdivision b of section 19-176.2. The use of micromobility dynamometers pursuant to such program shall be limited to instances in which a police officer has probable cause that a micromobility device observed operating on a street, in a park, or in another public place in the city is a motorized scooter. Such program shall prioritize micromobility devices operating in the 10 locations with the highest concentrations of micromobility device traffic and, to the extent different, the 10 locations with the highest rates of collisions involving micromobility devices.

c. Reporting. No later than April 30 of each year, the police commissioner, in collaboration with the commissioner of transportation, shall submit to the mayor and the speaker of the council and post on the department’s website a report which shall include, but need not be limited to, the following data for the previous calendar year:

1. The total number of micromobility devices tested pursuant to subdivision b of this section;

2. The number of such devices found to have an electric motor of greater than or equal to 750 watts or an electric motor capable of providing assistance when the device reaches a speed of 25 miles an hour;

3. For each such device found to have an electric motor of greater than or equal to 750 watts, the power output of such device;

4. For each such device found to have a motor capable of providing assistance when the device reaches a speed of 25 miles per hour, the highest recorded speed at which the motor provided assistance;

5. The number of devices impounded pursuant to subdivision c of section 19-176.2;

6. For each device impounded pursuant to subdivision c of section 19-176.2, the power output of such device; and

7. For each device impounded pursuant to subdivision c of section 19-176.2, the highest recorded speed at which the motor of such device provided assistance.

§ 2. This local law takes effect 1 year after it becomes law.
