Resolution approving the decision of the City Planning Commission on ULURP No. C 970422 MMQ, an amendment to the City Map (L.U. No. 401).

WHEREAS, the City Planning Commission filed with the Council on March 10, 2003 its decision dated March 5, 2003 (the "Decision"), on the application submitted by LHE II, LLC, pursuant to Sections 197-c and 199 of the New York City Charter and Section 5-430 et seq. of the New York City Administrative Code, for a change in the City Map involving:
* the elimination, discontinuance and closing of 22nd Avenue from Ditmars Boulevard to Berrian Street;
* the elimination, discontinuance and closing of Berrian Street from 22nd Avenue to 23rd Avenue;
* the elimination, discontinuance and closing of a portion of the westerly side of 23rd Avenue from Ditmars Boulevard to Berrian Street;
* the delineation of a sewer easement, and:
* any modification of grades necessitated thereby, and any acquisition or disposition of property related thereto,
Community District 3, Borough of Queens, in accordance with Map No. 4937, dated April 3, 1998, revised June 24, 2002 and signed by the Borough President (ULURP No. C 970422 MMQ) (the "Application");
WHEREAS, the Decision is subject to review and action by the Council pursuant to Section 197-d(b)(3) of the City Charter;
WHEREAS, upon due notice, the Council held a public hearing on the Decision and Application on March 31, 2003;

WHEREAS, the Council has considered the land use implications and other policy issues relating to the Decision and Application; and
WHEREAS, the Council has considered the relevant environmental issues and the Negative Declaration, issued on April 30, 2002 (CEQR No. 97DCP042Q);
RESOLVED:
The Council finds the action described herein will have no significant effect on the environment.
Pursuant to Sections 197-d and 199 of the New York City Charter, the Council approves the Decision.
