A Local Law to amend the administrative code of the city of New York, in relation to reporting on children present at arrests
Be it enacted by the Council as follows:
Section 1. Subdivision d of section 14-181 of the administrative code of the city of New York, as added by local law number 166 for the year 2019, is amended to read as follows:
d. Reporting. 1. Within 30 days of January 1, 2020, January 1, 2021, and January 1, 2022, the department shall submit to the speaker of the council and post on its website a report on the number of instances requiring a referral to a partner organization or transportation of the child to a child advocacy center pursuant to paragraph 9 of subdivision b of this section.
2. No later than 30 days after January 1, April 1, July 1, and October 1 of each year, the commissioner shall post on the single web portal established pursuant to section 23-502 and on the department’s website, in a machine-readable format, the following data on each arrest of a caregiver during the preceding fiscal quarter where a minor dependent of such caregiver was present at such arrest:
(a) A randomly generated unique identification number for the arrest;
(b) The precinct in which the arrest occurred;
(c) The date on which the arrest occurred;
(d) The number of such minors present at the arrest; and
(e) For each such minor:
(1) Whether the minor was left in the care of another caregiver; and
(2) The age of the minor, to be recorded in the following increments: under the age of 6, 6 to 10 years old, 11 to 15 years old, or 16 to 18 years old.
3. For purposes of this subdivision, the term “fiscal quarter” means the period beginning on January 1 and ending on March 31 of each year, the period beginning on April 1 and ending on June 30 of each year, the period beginning on July 1 and ending on September 30 of each year, or the period beginning on October 1 and ending on December 31 of each year.
§ 2. This local law takes effect 90 days after it becomes law.
