A Local Law to amend the administrative code of the city of New York, in relation to annual reporting on participation by city households in the housing choice voucher homeownership program
Be it enacted by the Council as follows:
Section 1. Title 26 of the administrative code of the city of New York is amended by adding a new chapter 40 to read as follows:
CHAPTER 40
HOUSING CHOICE VOUCHER HOMEOWNERSHIP PROGRAM REPORTING
§ 26-4001 Definitions. As used in this chapter, the following terms have the following meanings:
Area median income. The term “area median income” means the income limits as defined annually by the United States department of housing and urban development for the New York, NY HUD Metro FMR Area (HMFA), as established in section 3 of the housing act of 1937, as amended.
Commissioner. The term “commissioner” means the commissioner of housing preservation and development.
Department. The term “department” means the department of housing preservation and development.
Extremely low income household. The term “extremely low income household” means a household that has an income of not more than 30 percent of the area median income, adjusted for the size of the household.
Housing choice voucher homeownership program. The term “housing choice voucher homeownership program” means the housing choice voucher homeownership program administered pursuant to subsection (y) of section 1437f of title 42 of the United States code and regulations promulgated thereunder.
Housing choice voucher program. The term “housing choice voucher program” means the tenant-based voucher program administered pursuant to subsection (o) of section 1437f of title 42 of the United States code and regulations promulgated thereunder.
Low income household. The term “low income household” means a household that has an income of more than 50 percent of the area median income but no more than 80 percent of the area median income, adjusted for the size of the household.
Very low income household. The term “very low income household” means a household that has an income of more than 30 percent of the area median income but not more than 50 percent of the area median income, adjusted for the size of the household.
§ 26-4002 Reporting on housing choice voucher homeownership program. a. 1. No later than 1 year after the effective date of the local law that added this section, and annually thereafter, the commissioner shall submit to the mayor and the speaker of the council and make publicly available on the department’s website a report regarding the department’s administration of the housing choice voucher homeownership program.
2. Such report shall include a table in which each separate row references a borough of the city. Each such row shall include the following information concerning the department’s administration of the housing choice voucher homeownership program in the immediately preceding calendar year, set forth in separate columns:
(a) The number of households that participated in the housing choice voucher program through the department;
(b) The number of households that were eligible for participation in the housing choice voucher homeownership program administered by the department;
(c) The number of households that participated in the housing choice voucher homeownership program administered by the department; and
(d) The number of households that successfully closed on the purchase of a residential property through the housing choice voucher homeownership program administered by the department.
3. Such report shall include a second table in which each separate row references an income band of area median income: extremely low income household, very low income household, and low income household. Each such row shall include the following information concerning the department’s administration of the housing choice voucher homeownership program in the immediately preceding calendar year, set forth in separate columns:
(a) The number of households that participated in the housing choice voucher program through the department;
(b) The number of households that were eligible for participation in the housing choice voucher homeownership program administered by the department;
(c) The number of households that participated in the housing choice voucher homeownership program administered by the department; and
(d) The number of households that successfully closed on the purchase of a residential property through the housing choice voucher homeownership program administered by the department.
4. Such report shall include a third table in which each separate row references a category of household: with children, elderly family as such term is defined in section 5.403 of title 24 of the code of federal regulations or a successor provision, disabled family as such term is defined in section 5.403 of title 24 of the code of federal regulations or a successor provision, and single. Each such row shall include the following information set forth in separate columns:
(a) The number of households that participated in the housing choice voucher program through the department;
(b) The number of households that were eligible for participation in the housing choice voucher homeownership program administered by the department;
(c) The number of households that participated in the housing choice voucher homeownership program administered by the department; and
(d) The number of households that successfully closed on the purchase of a residential property through the housing choice voucher homeownership program administered by the department.
5. Such report shall include a fourth table in which each separate row references categories of race, as the substance and number of such categories are determined by the commissioner. Each such row shall include the following information set forth in separate columns:
(a) The number of households that participated in the housing choice voucher program through the department;
(b) The number of households eligible for participation in the housing choice voucher homeownership program administered by the department;
(c) The number of households that participated in the housing choice voucher homeownership program administered by the department; and
(d) The number of households that successfully closed on the purchase of a residential property through the housing choice voucher homeownership program administered by the department.
6. Such report shall include a fifth table that includes the following aggregate information:
(a) The number of households that participated in the housing choice voucher program through the department;
(b) The number of households eligible for participation in the housing choice voucher homeownership program administered by the department;
(c) The number of households that participated in the housing choice voucher homeownership program administered by the department; and
(d) The number of households that successfully closed on the purchase of a residential property through the housing choice voucher homeownership program administered by the department.
b. 1. No later than 90 days prior to the submission deadline for a report required under subdivision a of this section, the commissioner shall submit a written request to New York state homes and community renewal seeking information regarding New York state homes and community renewal’s administration within the city of the housing choice voucher homeownership program that corresponds to the information required under paragraphs 2, 3, 4, 5, and 6 of subdivision a of this section. The commissioner shall include in such report any information obtained from New York state homes and community renewal in separate tables, organized in the manner set forth in such paragraphs.
2. If New York state homes and community renewal does not provide the requested information in whole or in part, the commissioner shall include in such report a statement indicating what information was requested but not provided, along with the date on which the commissioner made the request for information.
§ 2. This local law takes effect immediately.
